Deeply conflicting emotions today.
Lula was convicted in open court. Ruling unanimously upheld by 3-judge appellate panel. Ensuing motions rejected by higher courts incl Supreme Court. So, this was not one “renegade” judge. He had due process.
Worth repeating: 5 of the 6 Supreme Court justices who voted against Lula’s habeas corpus motion yesterday were nominated by either him or Dilma. www1.folha.uol.com.br/poder/2018/04/…
STF decision (in practice) to maintain jail for defendants after “second ruling” was critical for Brazilian justice - it prevents convicts from remaining free indefinitely and encourages them to cut plea bargains.
The story of Brazilian justice has flaws but remains an inspiration across Latin America, showing powerful people in politics and business can be held to account. Many others trying to imitate.
On the other hand, if you’re intellectually honest, it’s impossible to justify why Lula is going to jail when so many other corrupt politicians walk free (& still hold office).
Impunity for other BR politicians is partly result of “foro privilegiado” but also specific decisions taken by Congress and other actors. Justice may come for them too, but it will take much longer.
Much of celebration at Lula’s impending arrest is Brazilians happy justice being done. But a lot of it is also disgusting class hatred.
Jailing the leader in polls for Oct presidential election will carry a cost, even if it’s not Moro’s job as judge to consider that. Millions will feel disenfranchised. Support for democracy, already lowest in LatAm, may continue to erode.
I’m worried about possible violence.
Finally - Lula was (and is) a powerful symbol who had two successful presidencies and was huge on global stage. It is a tragedy for Brazil that he is apparently heading to jail.
I think you can support justice and still feel sad about what happened today.
