Be informed that under section 47 of the #ICPCAct2000 (Forfeiture of Property upon Prosecution for an offence), the court shall make an order for the forfeiture of any property which is proved to be the subject matter of an offence. #IntegrityWednesdays

Section 47(2) says: where the offence is proved against the accused or the property has been disposed of, or cannot be traced, the court shall order the accused to pay as a penalty a sum which is equivalent to the amount of the gratification or is, .... #IntegrityWednesdays

.... in the opinion of the court, the value of the gratification received by the accused, and any such penalty shall be recoverable as a fine. #IntegrityWednesdays

Also note that according to provision of section 52 of the #ICPCAct2000,(Independent Counsel to investigate the President), when there is allegation of corruption against the President or Vice President, Governor or Deputy Governor, the CJN shall, .....#IntegrityWednesdays

.... If satisfied that sufficient cause has has been shown upon application on notice supported by an affidavit setting out the facts on which the allegation is based, authorise an independent counsel (a legal practitioner of not less that 15 yrs standing)...#IntegrityWednesdays

...to investigate the allegation and make a report of his findings to the National Assembly in the case of the President or VP, and to relevant State House of Assembly in the case of the Governor or Deputy Governor. #IntegrityWednesdays

Section 52(2) says the Commission shall be enjoined to fully co-operate with such independent counsel and provide all facilities necessary for such independent counsel to carry out his functions. #IntegrityWednesdays
