The Supreme Court asked the tribunal to adjudicate on the INEC server matter after listening to evidence from all parties.

His excellency Alhaji Atiku Abubakar has proven beyond reasonable doubt with oral and video evidence that INEC has a server.
Atiku called INEC RATECH and POs & APOs of INEC who gave unchallenged evidence that they electronically transmitted results of the Presidential Election to the INEC Server.
The testimony of ICT expert from Kenya who testified to the existence of the server belonging to the INEC,
proved not only the existence of the Server, but also the authenticity of its contents and the election results contained therein.
INEC led no evidence to support its denial of this fact and it is trite law that "where a party fails to lead evidence in its pleading,
the pleading is deemed to be abandoned." In EMMANUEL vs UMANA (2016) the Supreme Court held thus: ''Pleading of averments in proof of which no evidence is offered, virtually serves no useful purpose. Averments in pleadings, which are unsupported by evidence, are useless,
and so must be discountenanced."
