Shiv Sena's petition in Supreme Court is a no-holds-barred attack on BJP.
It states that Sena had been associated with BJP in Maharashtra for last 30 years but owing to certain fundamental political differences during last few weeks, that association has come to a staggering end
It states that Shiv Sena has been in advanced talks for government formation with the NCP and Indian National Congress. It is for evolving a common minimum programme that three days' time was sought from the Governor which was disallowed.
Sena alleges that the action of Governor in rejecting 3 days' time is part of the well-concerted plan of BJP to invoke Article 356
Any imposition of President's rule would result in horse-trading by BJP and allow it to "somehow cobble up majority by using unconstitutional means"
Governor is duty-bound to allow reasonable time to political parties to conclude their negotiations on government formation and he/ she should not act as an agent/ mouthpiece of the Central government, Shiv Sena contends.
The action of denying time to Shiv Sena is ex-facie arbitrary and contrary to Article 14, Sena has contended.
It has, therefore, sought quashing of Governor's decision of November 11 and also prayed for a direction to be issued to Governor to grant Sena reasonable time to demonstrate that it has requisite support to form government in Maharashtra.
