Mann's strategy, all along, was to drag the case on for as long as possible. He couldn't win on the merits. If he produced the documents Ball demanded, so the case could proceed, Ball would have won on the merits, so Mann wouldn't do that.

That gave him a big advantage. His strategy was to just keep stalling, trying to exhaust Ball's more limited resources by dragging the case on forever:

Mann lost, and Ball was awarded costs. I.e., Mann had to pay ALL court costs, of both the motion & the original action.

But not lawyers' fees. (Court costs & lawyers' fees are different things.)

Fortunately, Dr. Ball refused to be bullied.

Mr Scherr was Dr Ball's attorney. He asked that the court award his client the costs, meaning that Mann would have to pay them. Mann’s attorney knew there was no point arguing, & he didn't try. The court agreed.
