In court hearing, Assistant Attorney General Robert Reichel says the state is seeking to "temporarily, not indefinitely or for weeks as Enbridge suggests” keep #Line5 east leg shut down pending state probe of the condition of the east leg, where steel support was damaged.

"That issue of permanent closure is not before the court," Asst. AG Robert Reichel says.

State is seeking a continued shutdown of the west leg of #Line5 in the Straits of Mackinac pending outcome of state probe of its condition.

“A limited extension of the west line shut down is both appropriate and warranted,” Assistant Attorney General Robert Reichel tells Ingham County Circuit Court Judge James Jamo.

Enbridge attorney David Coburn says the "state simply cannot regulate" operate of #Line5 because it's a federally-regulated interstate pipeline.

"The attorney general's case is basically based on fear, not facts," said Coburn, a partner at the D.C. law firm Steptoe & Johnson.

The 1:30 p.m. Ingham County court hearing over keeping @Enbridge's #Line5 shut down is still going on.

Question being litigated boils down to this: Does the state (EGLE, DNR) have regulatory oversight of the supports in lakebed that stabilize the pipeline regulated by the feds?

Ingham County Circuit Court Judge James Jamo just ended a 4.5-hour-long hearing over temporary shut down of @Enbridge’s #Line5. He said he’ll issue a written order on whether to keep it shuttered for 14 more days while state reviews safety.
