27. Settlement with Comunidades Unidas Por Un Cambio.Under the recommended Settlement Agreement, the County would pay $130,000 to petitioner Comunidades Unidas Por Un Cambio’s attorney, Leadership Counsel for Justice and Accountability. There are sufficient appropriations for
payment in the General Fund FY 2020-21 Adopted Budget Org 2540, Account No. 7295. The court found that the County did not timely implement certain programs in its 2016-2023 Housing Element and did not timely adopt the analysis of the infrastructure
deficiencies for certain disadvantaged unicorporated communities as required by Government Code 65302.10. Now, the petitioner seeks its attorney’s fees incurred in this litigation.

41 and 34 items have been deleted from Consent Calendar. Brandau pulls item # 30. 3.Adopt Resolution directing the Public Health Director and Fresno County Interim Public Health Officer to provide support to Fresno County Schools servicing special needs students desiring to
to return to onsite instruction for physical therapy and individually guided learning sponsored by Brandau; He says he “had a fuller resolution but Governor Newsom has recently made some changes that have helped this situation.” Staff: we have worked with school superintendents
to help do this as completely as they can. Brandau: 14 special needs students per classroom allowed now? Staff: cohorts of 14 with two adults. They need to stick together with no mixing with other schools. Assessments are one on one and can be done safely and legally. Brandau:
Families say it often takes 11 adults to provide education for some special need students. Brandau says he is happy with Governor’s decision.
Pulled Item #30 now heard. Staff: position being created as Chief Operating Officer. It takes three meetings to approve this and it is now third meeting. It will be open for applications September 17. $123,000 to $190,000 salary range. It will be in addition to CAO Rousseau
@LincolnSeward Magisg: salary will depend on experience of candidates. Staff: this is designed to be fiscally neutral for CAO Office. There may be a deputy CAO position as well. Approved 3-2 with Brandau and Quintero voting NO.
4.***Determination of Public Convenience or Necessity on Application for Alcoholic Beverage License Type 21 for Falcon Junction, Inc.
Upgrade license to Type 21 from current Type 20. This allows distilled spirits to be sold along with current beer and wine. There are four allowed in census tract but currently 7 including applicant’s own Type 20. There are three .1 miles from this one.
Magisg: @LincolnSeward Rural nature makes this Census Tract very large. Public: Representative of Falcon and thanks Supervisors and Jordan Scott. Magisg: I have not heard any complaints from residents. Approved 5-0
5.Amendment to Master Schedule of Fees - Human Resources. This is for Third party services provided to be sure costs are covered. Approved 5-0.
5.1.Ratify the Agreement a Fresno Economic Opportunities Commission for the COVID-19 Equity Project - Base, previously executed by the County Administrative Officer acting as the Emergency Services Director, effective August 19, 2020 through December 30, 2020 ($4,039,556); AND
ratify the Agreement with Fresno Economic Opportunities Commission for the COVID-19 Equity Project - African American Coalition, previously executed by the County Administrative Officer acting as Emergency Services Director, effective August 7, 2020 thru December 30,($1,648,671)
Will help with culturally appropriate education, outreach, testing and tracing of Covid-19. Close contacts and quarantine especially in families. Single data base so it can be determined who was contacted. This leverages community groups. @LincolnSeward Magisg we have talked
about this before. Clerical error is corrected. Staff: 20% advance to help prime the pump. Fully expenses at the end of project. CARES Act dollars so we are very careful. Magisg: he has worked with EOC for Five years and worthy group. Approved 4-1 with Brandau voting NO
