Another DISGUSTING proposed rule from EOIR to completely f*ck over asylum seekers. WHEN WILL THIS BULLSHIT END? A THREAD:
Asylum applications are 12 page applications. It asks about years and years of background information, as well as info on the harm a person has experienced or fears. It uses legal terms of art non-lawyers cannot understand and must be completed in English.
The government is trying to require asylum seekers to file this document with 15 DAYS of their first preliminary hearing - a COMPLETE IMPOSSIBILITY for anyone not represented at their first master hearing. It also purports to add reqs to what a "complete application" looks like.
This is yet another roadblock the administration is attempting to put up to make asylum completely inaccessible to nearly everyone, particularly those without access to English speaking resources.
I STRONGLY SUSPECT this rule will also directly support the death to asylum rule by giving IJs all of the ammunition they need at the filing of the application to determine, without a hearing, that what they see in the application "doesn't qualify" for asylum.
The government continues to focus their racism and xenophobia on the asylum seeking population. @DOJ_EOIR continues to show it is NOT a neutral adjudicative body but rather an immigration enforcement arm similar to ICE and CBP. WE NEED INDEPENDENT IMMIGRATION COURTS.
This proposed rule is trash and is designed to be another procedural obstacle to asylum. The best part? @DOJ_EOIR adds that immigration judges can SUBMIT AND CONSIDER THEIR OWN EVIDENCE in asylum cases. They aren't even PRETENDING that they are neutral adjudicators. ICE 2.0.
