Here's a helpful @hrw review of the mysterious case of the “HK 12” still secretly held in Shenzhen. I've been told that there's a Chinese language report in a mainland paper that the group has now been formally “arrested”...1/n

...but that the report did not indicate what the charge is. If anyone has seen a report on the issue of formal “arrest,” please let me know. It may be that the paper was merely noting, belatedly, the reason alleged for the Aug. 23 detention. 2/n

If the group is being processed in the normal way, within three days there may be an announcement about their arrest and the crime(s) alleged. But, as the HRW message indicates, if there's no announcement, one may infer that the group is being held under RSDL. 3/n

Sadly, since the 2012 “reform” of the Criminal Procedure Law, locking suspects up for up to six months of incommunicado detention has been authorized by law if the police decide that in their view there is a basis for investigation of a possible “national security”...4/5

...(or major corruption or terrorism) violation. These legislated exceptions to the regular criminal procedure have made a mockery of the hard-won genuine reforms that many PRC justice experts have achieved since 1978. 5/5
