Oral arguments are scheduled for next Monday, January 25. They will be streamed live.

One of the key Qs raised by the Court during oral arguments this morning was whether @US_FDA had consulted with its advisory committee, Technical Electronic Product Radiation Safety Standards Committee (TEPRSSC), when responding to @FCC with regard to its rules on #RF safety.

Counsel for the @FCC could not answer.
The answer is surely No.
TEPRSSC has been inactive for years. Its last formal meeting was held in October 2016. #RF safety was not on the agenda. Before that, the committee had last met in 2003.

TEPRSSC has, by statute, 15 members. As of end of 2020, there were 10 vacancies. The terms of all 5 members expired December 31.
So at this point, there are no active members of TEPRSSC.
Among the 5 were: Martha Linet, retired from @theNCI and Antonio Farone of @MotorolaSoluti2

The Court also asked whether @FCC had consulted with the #RF Interagency Advisory Group (RFIAWG). No answer on this too. This is a more informal group. Both FCC and @US_FDA have reps on RFIAWG. It also has been largely inactive.

The Court asked that the @FCC supply information on the status of both TEPRSSC and RFIAWG by 5pm tomorrow, January 26.

In 1999, RFIAWG raised 14 "unresolved" issues related to the @IEEEorg's #RF exposure standard. (@FCC has long relied on IEEE for guidance.) Though the IEEE standard has since been revised, many of those 14 issues are still relevant >20 yr later.
