🧵So an update on the AH insurance drama to head off any phony baloney from lolyers. Clearly it appears that this fight is purely between New York Marine and Travelers over the huge costs of the already settled case. Doubtless in settling AH has handed this over to Travelers.
New York Marine alleges clearly that Travelers controlled the firing of NYM’s chosen firm. NYM also takes potshots at Travelers’ allowing the lawyers to blow through $10mm in fees.
NYM and AH are still in a case that must be under some kind of deal between AH and Travelers for her to cooperate at no cost. NYM even argues AH can’t fight NYM because she already got defended by Travelers.
Thus while I was incorrect that all this litigation must have been settled already it’s because Travelers appears to have assumed all of AH’s risk over the $10mm already spent to induce her to forego the chance for a retrial and millions more in cost. I bet AH faces no risk
from any of this, it’s a duel between NYM and Travelers over the $10mm. Moreover NYM clearly points the finger at Travelers more so than AH. Travelers has a reputation of defending insureds and paying claims. It’s why they get business and higher premiums. They aren’t dupes.
#Amberisfree and the insurers are still fighting, AH is nominally a party that she can’t be paying for. Why does she care which of NYM or Travelers had to pay for the lawsuit she never asked for?
