SORRY STATE OF AFAIRS IN INDIAN JUDICIARY..
🧵
Yesterday, at 8 PM, a special bench of, our Supreme Court held a sitting to hear a matter, suo motu..

1/16

The cause of action was this..👇
One judge J. Gangopadhyay of, Calcutta High Court had given an interview to a local TV channel about a case concerning Abhishek Banerjee before his bench..
J. Gangopadhyay directed the Secretary General of the Supreme Court to submit report+

2/16

+and some documents pertaining to the SC's order of reassigning matter pertaining to Primary Teachers' Recruitment Scam, which were heard by his bench..
The main reason behind this order of reassignment from SC seems to be J. Gangopadhyay's interview to a local TV channel..

3/16

The Supreme Court in its' suo motu action, stayed the order of J. Gangopadhyay, primarily on the ground of judicial discipline.

4/16

If giving interview to a TV channel and talk about a case, which he was hearing in his court and, which was not finally adjudicated was judicial indiscipline, then a precedent had been set by the #CJI J. Chandrachud himself..
In #IndiaTodayConclave on 18th March' 2023+

5/16

+ he made some comments on a matter related to appointment of Advocate Saurabh Kirpal as a Judge in Delhi HC..The #Collegium led by J. Chandrachud had reiterated recommendation to appoint him as a judge of Delhi High Court, in January' 2023..Union Govt is processing this+

6/16

+reiteration from the SC #Collegium..Yes, that reiteration can be read on the website of the Supreme Court but, the question is, was it appropriate to discuss this in a TV channel interview?

Where was the judicial discipline, which normally one expects from the #CJI?

7/16

Now coming to a request J. Gangopadhyay made to Chief Justice of Calcutta HC & the Chief Justice of India in last April..In this written request, he had alleged that a lawyer had approached him to speak on behalf of an influential politician involved in cases heard by him+

8/16

What action did the Chief Justice of Calcutta High Court and for that matter the Chief Justice of India have taken, in this allegation made by J. Gangopadhyay in writing?

Indian public has a right to know, whether any action was taken by the Chief Justice of India?

9/16

There have been 3 instances out of which, in 2 instances the judges of the Supreme Court of India had abdicated their responsibilities without assiging any reasons..J. Anirudha Bose and J. Indira Banerjee recused themselves from hearing cases related to Bengal.

10/16

Did the Chief Justice of India seek explanation from J. Aniruddha Bose and J. Indira Banerjee, as to the reasons for recusing themselves from cases assigned to them?

Justice Indira Banerjee displayed professional misconduct in another important case too..

11/16

She has retired last September & enjoying pension/perks from tax payers money inspite of not doing her judicial duty.
Then #CJI never censured her for her Professional misconduct..Then or present CJI has not sought explanation from J. Bose, for recusing himself from case.

12/16

In her election related case, Mamata Banerjee who had lost against BJP's Suvendu Adhikari, from #Nandigram, had filed a petition in Calcutta High Court..Mamata Banerjee mounted pressure on J. Kausik Chanda in Calcutta High Court to recuse himself from hearing the case..

13/16

It can be seen from the above instances, both the Chief Justice of Calcutta High Court and the #CJI had turned a blind eye to judicial indiscipline and abdicated their duty of protecting constitution for, which they had taken an oath at the time of assuming their offices.

14/16

Finally, how can one Constitutional authority talk to another Constitutional authority in such intimidating tone & langauge? This is a tapori language used by goons in the underworld..
AG addressed J. Kaul as 'our lordship' & in response J. Kaul addressed him as 'Attorney'

15/16

AG -Attorney General of India..He is the highest law officer of the country...A Constitutional authority..He has to be addressed respectfully.

The following👇 are all other examples of Judicial INDISCIPLINE..No action has been taken by the #CJI on any of these statements.
