I’m here at the Larry Millete trial…with no seat! I’m the odd one out today. That’s okay: it’s for family. I’ll wait here to see if anyone leaves.
A witness just left. I’m not sure who he is. But he and his wife decided not to stay and watch the trial, though they were offered seats by part the prosecution team.
The interesting tidbit for YOU: the member of the prosecution team speaking to the witness in the hall here told him that it’s just cell phone data left. The prosecution will rest very soon.
The cell phone stuff I expect? The evidence (and/or missing evidence) from Larry’s location data. I’m not sure who is on the stand now, but it may very well be a cell phone data expert. I do expect some cross examination as the defense attacks the investigation (their strategy).
My friend left and I’m in the courtroom after the break. People were bored. It’s financial records.
Mr Rhoades is up revealing Larry Millete’s financial records. When they left off, Bowles says, Rhoades was discussing how many car washes Larry bought: 9 That’s between Jan 16- Feb 1
Fashion update: bowles is in a grey pantsuit and black heels. Rhoades, on the stand is in a dark navy or black suit.
Bowles and Rhoades discuss the TSP loans that were taken out - this is a retirement account, if you’ll recall. There were loans taken out but nothing after Jan 7th. 2018 $35,000 was dispersed.
Fashion update: Sabatini is in a brownish purple reddish pantsuit, Larry Millete is in a Cerulean (Really) sweater with plaid button up underneath. Mr Ryan is in a blue suit with purple pocket square and tie.
On Screen we can see some of the TSP loan Information. The 2018 loan is default. Also, Larry Millete is wearing headphones today.
Some jurors look bored while most are leaning in and/or taking notes.
Bowles asks if any months in 2020 were particularly active as far as financials - Rhoades says that yes, April and May were active with taking out loans.
Moving onto crytocurrency…there’s 3 cryto accounts for larry millete listed on screen. Most actions with these accounts were prior to 2020, Rhoades says.
There was no indication that May Millete had any access to these crypto accounts; larry was the only identified user, Det Rhoades says.
“Obtaining these records were a little bit difficult,” Rhoades says
Rhoades talks about how high the security is on crypto accounts because they are more “user dependent” than a financial institution.
Search Warrant for Naval Medical Center (Balboa) on Oct 26, 2021: Rhoades is talking about executing the search warrant at Larry’s workplace and what was seized.
On screen we can see the photos from the search warrant. Larry’s office is shown. We can see where Larry‘s computer was and also where Terry Fonville’s computer was in the same workspace.
NCIS had to screen all of the devices that Rhoades wanted to seize before they could look at them. Rhoades says they received a digital record.

Some jurors are watching Larry Millete now.
On screen, we have photos of Larry’s close family members. It’s a little family tree.
This is kind of weird because some of them are in the courtroom.

Terry Fonnville is listed as a coworker On this map.
His uncle, aunt, father and mother are on screen, as well as his brother. Now we’re moving onto a hard drive.
Bowles shows witness an exhibit. It’s an image of a hard drive. We have seen this before. It’s a Toshiba 4 TB hard drive
Bowles asks if the data was parsed. It’s a yes. There were items of evidence, Rhoades says.
Sabatini and Bowles confer. Bowles checks something. Then moves onto the next exhibit on screen. It’s Images of Maya’s Locations - 4 satellite images that are screenshots from “Find my iphone” app
1:23 PM was one of the times a screenshot was taken. These screenshots all show May in a parking lot. Larry leans over and says something to Sabatini and she nods very enthusiastically several times.
Rhoades is explaining “find my iPhone” to the jurors after Bowles asks him to. Someone sneezes. The judge is the sole person to say “Bless you” (Maggie note: i appreciated that.)
1:50 PM is the second screenshot. These are all from January 27, 2020. Rhoades says the screenshot times are ascending.
Rhoades says that one must intentionally put these photos on a hard drive - like plugging it in. On screen we can see more ascending time screenshots. And pictures. Taken from a parking lot. The final image is taken of a truck in the lot.
Times: 2: 45, 2:46, 2:46 are the times of the next screenshots (same place, same phone - May’s).
Bowles asks about Rhoade’s police work experience, and he has worked in domestic violence, trained in domestic violence, and taught domestic violence police policies and procedures.
Bowles asks if “stalking” cases is something Rhoades is trained in. Rhoades says yes, that’s part of his job - call detail records, location information are all important in those types of cases.
Bowles asks if these screenshots were significant to Rhoades and Ryan objects As to improper opinion. Judge says we will end because there will be a sidebar to decide that issue.
I’m staying in the courtroom to catch this sidebar now that the jury has left! Sabatini argues that Larry is not charged with stalking
“This might be a personal or legal opinion that is inadmissible“ she says
“I don’t think that having this witness testimony…is appropriate at all” Sabatini adds
Bowles: “the flip side is that often friends and family track each other, and the purpose is for Rhoades to explain why these exhibits are significant.”
“Particularly the fact that the defendant saved all those on an entire hard drive…”
“Provide context that…it is different from simply finding a screenshot or two,” Bowles argues.
“The other images that are in the exhibit are dozens of selfie images that appear to be may millete that appear to be not particularly looking happy about it.” Bowles
Bowles argues this is to provide context
“I understand the objection,” Judge C says. “It’s not officially stalking unless you have a threat of some kind.…I think you’re asking him ‘what does this mean’ I think that’s your job in closing argument, not the detectives’ job. I’m going to sustain the objection.”
Sabatini has objections to to some slides In this exhibit. It’s about the selfie pictures. “It’s circumstantial evidence that corroborates tracking,” Bowles explains
“I get that we have a digital device that we want to talk about everything that’s on it, it’s not like these pictures had a caption…we can come to our own Conclusions…but for the witness to impute opinion…” Sabatini says.
”interpretation of the status of her hair, how her face looks…that may be of some value. I‘m going to overrule.”

The next objected to slide is a photo of another phone
Sabatini says that there is no context with these photos and it leads to speculation.
Judge C says “the issue of control, monitoring, annoying her, little by little or by big chunks is a relevant issue and frankly the record shows that occurred on more than one occasion through the litany of witnesses…”
Judge says it’s relevant and the objection is overruled. But the next slides have more stronger issues: Screenshots of a phone of Jasmine Lux’s phone.
Bowles believes this corroborates that Larry is the user saving these screenshots on the hard drive.
Sabatini says she thinks there are obvious objections and gets into rule 352. “There’s no state of mind here…these screenshots contain hearsay, double hearsay…”
“Frankly Mrs Millete’s responses…it’s cumulative.“ Sabatini adds.
“This is problematic because of the irrelevant hearsay within in it…” Sabatini says
Judge C: I have some concerns about 352….
Judge C seems like he’s gonna sustain as he says his ruling:. “I’m excluding the screenshots,” he says.
Slide 13 “I guess this is a similar slide in that it’s now capturing messages of Ms Shin…” Bowles says “Yes but some of the messages have came in through Suzanne Shin…I think they have particular relevance now that they are being saved by the defendant”
“The defendant is aware of Mays conversations with her friends,” Bowles adds.
Sabatini says this was excluded in limine and the prosecution is trying to bring thse screenshots in another way.
Judge C says that he is sustaining the objection - but if Bowles redacts some things it would be okay to bring in.
“What’s different about this your honor is that we don’t actually have evidence of WHAT HE KNEW.” - Bowles
The messages Show may discussing that she is afraid to leave Larry because of the kids, which the judge and sabatini say is cumulative.

More updates now that I’m finally home with the kids (lots of driving): Judge Camarena said the prosecution will REST Monday, and then the jurors will have a long break- because the defense will probably make a directed verdict or judgement of acquittal motion
A JOA or Direct Verdict is done in most trials and almost always denied. The defense will say there’s not enough evidence/the state hasn’t met their burden. Likely the judge will say, it’s for a jury to decide. (Just if you didn’t know!)
What I missed today: Patricia, Jamey Laird’s now ex-wife testified that Jamey was at the hospital for their baby on Jan 7th the whole time. She said Larry called her and she had to block him. I’m told she was stoic. She works for the SD county Sheriff.
Courtney Nixon also finished testifying. Sources say it was an emotional end of her testimony, and the defense did not cross examine.
Maya’s therapist also testified today. He is the man I saw leaving as I waited for a seat to become available. He said similar things to Maya’s friends as to her state of mind. Maya was DONE. And a professional was able to testify to that fact.
Det Rhoades was the final witness today. He testified to financial records - Maya didn’t access any money after Jan7
