NEW: A judge ruled today that special counsel Mueller’s case against Concord Management - the Russian firm accused of funding the Internet Research Agency ("troll factory") -- can proceed, denying the firm’s motion to dismiss for a 2nd time.
In their argument to dismiss, lawyers for Concord Management (the Russian company accused of funding the "troll factory") cited a 2011 decision on foreign spending in U.S. elections written by Brett Kavanaugh.

It failed.
Context for today's ruling --> Lawyers for Concord Management argued that the charges should be thrown out, citing Kavanaugh’s 2011 decision in Bluman v. FEC, which would restrict the scope of the federal ban on foreign spending in U.S. elections.…
Kavanaugh believes it violates the 1st Amendment to ban foreign $ in US elections. He thinks foreign countries should be able to pour $$ into ads & other activities aimed at influencing US elections — as long as they don’t explicitly endorse a candidate.
Kavanaugh's interpretation of the Federal Elections Campaign Act would leave the door open for unlimited spending by foreign powers on "issue advocacy," meaning that most of the campaign activity attributed to Russian operatives in the 2016 election would've been legal.

So yea.
So it's good that the judge struck down Concord's motion to dismiss.

BUT: Kavanaugh's record on campaign finance suggests he would strike down disclosure laws, making it easier for dark $ to flow into our political process — and harder to find out when it’s done illegally.
Beside the domestic problems with dark money in politics, this could also make it easier for countries like Russia to covertly fund U.S. political candidates and campaigns by funneling money through U.S.-based organizations ... like the NRA, perhaps.
