DOJ has tried and failed 11 times to stay @NewYorkStateAG & co’s #Census2020 case (or parts of the case). This is now attempt #12.
@NewYorkStateAG Unreal: DOJ just filed a motion to stay our #Census2020 case w/ the 2nd Circuit -- before the district court could even rule on the motion they filed yesterday. As @NewYorkStateAG Underwood has said, DOJ continues to show a remarkable lack of respect for the judicial process.
Read our latest filing in @NewYorkStateAG & co’s #Census2020 suit - calling out DOJ for its astonishing TWELVE attempts to delay proceedings over the last 11 weeks. The record clearly shows that Ross’ decision to demand citizenship status is illegal. ag.ny.gov/sites/default/…
The 2nd Circuit just denied DOJ’s motion to stay @NewYorkStateAG’s #Census2020 case, telling DOJ to wait for the district court to rule.

AG Underwood has repeatedly called out DOJ‘s remarkable lack of respect for the judicial process as they’ve tried to skip over lower courts.
Now the district court denies DOJ’s motion to stay @NewYorkStateAG’s #Census2020 suit. In response to this 12th attempt by DOJ to block our case, Judge Furman writes “enough is enough.” ag.ny.gov/sites/default/…
After Judge Furman’s 🔥 decision yesterday denying DOJ’s 12th attempt to stay @NewYorkStateAG’s #Census2020 case, the 2nd Circuit also (again) denied the stay this afternoon.
The trial in AG & co’s #Census2020 suit ended today. The record clearly shows that Ross’ decision to demand citizenship status is illegal - intended to discriminate, while threatening states’ fair representation & federal funding.

We’re confident in the strength of our case.
