Tempo for construction of Ram Mandir gaining momentum; lakhs of faithfuls and saints, camping in Ayodhya to press their demand. Udhav Thakre has demanded passage of Ordinance, pledging his support for it in Parliament.
This is smelly. Modi-hating politicians can’t be so helpful, so straightforward, to be taken on their face value. So clearly they want to pressurise the Govt to adopt the Ordinance route ONLY.
Getting a feeling that SC is going to be a spoilsport even in January. CJI Dipak Mishra had cleared the decks for a quick judgement, by rejecting scores of ‘faltu’ petitions; and deciding that a mosque was NOT essential for prayers under Islam.
So nothing much was left to argue. Allahbad HC had already given a verdict that a Mandir existed below the mosque before; and that 2/3rd of the disputed 2.77 acres land be given to Hindu parties (1/3rd to muslim party).
SC could have easily ordered the Govt to compensate the muslim party by allocating alternate site. This is a normal thing in any land dispute. Was the need of hour; more so when the issue is connected to the faith and sentiments of a billion plus majority,
They are now losing patience due to inordinate delays by the courts. But apparently SC couldn’t care less. It is actions like this which make people lose faith in them; doubting impartiality... CJI's utterances that it was not a priority for instance.
Taking (junior-most) KM Joseph on the bench itself was sufficient indication of his mindset. BTW wasn’t it Gogoi along with 3 others who took his grievance to media against the then CJI Mishra for ignoring senior judges in allocation of important cases!!
Though this is not the only case; we saw a sort of their u-turn in Rafale also. Does the SC want to toe the line demanded by Sibbal's who in this case, had demanded that hearings be postponed till after 2019 elections!!
Apprehension is they may now go a step further; may pass an Order asking Govt to maintain status quo till they decide the matter. Which means putting a ban on promulgation of Ordinance also. Though, doubt if such Order can be passed; or seen to be legally correct.
But who decides? Haven’t they rejected a perfectly lawfully passed NJAC Act by Modi Govt! And, assigned themselves the power to appoint judges to higher courts, including themselves in the SC!
