1.) Dear .@Jack,
The Battle for the 1st Amendment has an interesting backstory, not unlike the story of .@Twitter wanting to steer the narrative in a “family friendly” direction today.
The landmark case for the 1st
2.) Amendment began after Larry Flynt decided to start publishing Hustler, a magazine that most ppl are aware had been pushing the envelope of taste that was being portrayed in Playboy, from the very
3.) beginning. At the same time in American history, the Reverend Jerry Falwell was the leader of the Moral Majority. So, Falwell and Flynt began blasting each other at every opportunity.
4.) But then one day, Larry Flynt woke up and decided to publish a parody of the most Reverend Jerry Falwell, describing his "first time" as having been with his mother, "drunk off our God-fearing asses," in an outhouse.
5.) Evidently, the Reverend Jerry did not enjoy Larry’s sense of humor, because Jerry sued Larry for libel in federal court in Virginia. Opening arguments began in 1983, and ended with Jerry for the win in 1988.
6.) But since Larry wasn’t about to pay Jerry $200K for hurting his feelings or, as his lawyers called it, "intentional infliction of emotional distress." Larry decided to appeal to the U.S. 4th Circuit Court of Appeals, and lost for a third time.
7.) Having never really entertained the thought that the SCOTUS would hear the case between a pornographer and a preacher, the SCOTUS did in fact agree to hear that case because the 1st Amendment was so much at the
8.) heart of the case. And this time, Larry won.
Larry won because the SCOTUS felt that the magnitude of importance that the 1st Amendment carries with it is so germaine to the American experience that We the Ppl must be heard, once and for all.
8.) But today, regardless of whether it’s intercourse or discourse, the battle grounds are again being drawn. Nobody has the ability to work it out amongst themselves when one guy decides who steps out of line, then
9.) comes and takes that voice away.
Each individual voice in America really is that important. Especially so, when each voice has the opportunity to interact directly with their POTUS,
10.) and the ability to read the info from the POTUS that affects the entire world, in its intended context. That’s how important one voice can be.
11.) We don’t need an arbiter to steer our narrative, because that’s why we vote. So let’s celebrate Jesus this Easter, instead of resurrecting the 1st Amendment.
