1- Classic example in this article from @jamescdownie on why the Left is losing badly on impeachment (as they should, it's an idiotic position). They constantly shift between a legal argument (see cutout) & a political argument (cont).

2- The legal argument is settled. Mueller declined to make a decsion, so Barr + Rosenstein determined there was insufficient evidence. Barr repeatedly confirmed - per their discussions with Mueller - this was NOT based on DoJ guidance around a sitting POTUS indictment (cont.).
3- So it's NOT a legal matter. There's no sealed indictment waiting for Trump when he is out of office. The comment about obstruction statutes applying to a POTUS is irrelevant, as that's a legal argument.

It's a poltical matter (cont).
4- But that's as it should be. Impeachment was designed to be a political process. Hence the phrase "and Misdemeanors", which can mean anything. So let's look at this politically, since it's the only real view that Mueller left the Dems (cont).
5- Impeachment proponents would be asking Americans to remove a POTUS for actions that 1) don't even rise to the level of a legal crime, & 2) are centered around "obstructing" an investigation into allegations that indisputedly (per the same investigation) never occurred (cont).
6- Not to mention, an investigation that was never actually stopped, where the Admin provided millions of documents, & where the Admin waived Executive Privilege including allowing Don McGhan to testify for 30+ hours. This is not the behavior of guilty people. (cont).
7- That dog just doesn't hunt with the American people.

The fact is, the Dems have boxed themselves into a terrible situation. They were sure Mueller would deliver the goods. They went all-in on a dumb hoax that anyone (including me 👇) could see early on was ludicrous (cont).
8- They promised the lunatic base impeachment & now they can't deliever. Plus silly media actors like @jamescdownie want it, of course, because of clicks. And so they can contnue the delusion that somehow post-2016 journalism was not the dumster fire that it is (cont).
9- So the Dems are boxed in. The rabid base & Media allies on one side, the lunacy of the argument & the inevitable political backlash on the other. What's a Party to do? Right now, they're fence-sitting, as the Wapo article acknowledges (cont).
10- But that won't last. My own prediction is Pelosi will slow-walk it until 1) the base becomes fatigued of it & lets up, and/or 2) the #SpyGate relelations - e.g. upcoming OIG report on FISA abuse - show it's untenable (cont).
11- But the Dems just may do it. It would fail, of course, becasue there is no way 20 GOP Senators would fliip on this lunacy. So it would ultimately be a political stunt. And a bad one at that (cont).
12- But we shall see. The current Dem House caucus so far hasn't shown much judgement. Or much of anything, really.
