Impeachment is Politics: I'm So Confused: A Dizzy Dirk Thread
I spent Saturday playing rock and roll and drinking beer in the sun. I spent today playing my preferred field sport (ultimate) in the high noon sun. My brain may be addled. AND I CAN'T MAKE SENSE OF THE DEBATE ON @TeamPelosi 's decision on impeachment.
I have argued that Nancy Pelosi SHOULD weaponize the impeachment process to do the most damage to Trump's chances (and Senate R's changes) of winning election in 2020. And I think/hope/pray that that is what she is doing.
The essence of this argument is that the Senate as presently composed will never convict trump (remove him from office) no matter the evidence because many Senate Rs are also guilty of violating their oath and they can't personally afford to lose Trump.
Trump's voters will never shift from Trump and the GOP disinfo machine will crow about how the Dems and the Deep State lost and Trump won. That, and playing the victim card, would help Trump in 2020. There can't be a second chance to impeach -- it would be political suicide.
The counter argument, advanced by many accounts I respect, including @LouiseMensch and @xtrixcyclex , is that Pelosi and the Dems have a moral and patriotic duty to lead from the front and begin impeachment.
Louise, whose sources in the IC community are significant and much greater than mine, says she is told that key indictments are not being unsealed because the IC/DOJ will not indict until impeachment begins because impeachment is tied to a limit on the POTUS impeachment power.
Smart accounts worry that if Pelosi delays impeachment much longer, then no indictments will be unsealed because that would interfere with an election, in violation of longstanding DOJ policy to try to avoid impacting elections.
I trust that this is what Louise's sources are saying. If that is what DOJ/FBI/FVEY's leadership is saying, however, I think they are incorrect. Here's why:
1. The Framer's set up 2 modes to remove a POTUS - impeachment and election. Both are inherently political. Impeachment involves by politicians in the House and the Senate. There is no independent jury or judiciary. The Chief Justice presides in the Senate, but does not vote.
2. When the Framers made politicians the finders of fact and deciders on removal from office, they left the decision to politics. Nancy Pelosi is a political animal - that's her job. She should be expected to see the good of the US as an issue of political success (and it is)
3. The Constitution does NOT say the House must impeach if an official commits a crime. It just puts that power in the House. The Framers believed that the vote was the primary means of policing politicians. The Framers DID NOT disqualify a POTUS that committed a crime.
4. The Constitution does NOT clearly state POTUS can't pardon co conspirators or potential witnesses against the POTUS if impeachment started. It says POTUS: "shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment".
5. "cases of impeachment" as used here includes all officials that can be impeached so POTUS can't use to pardon power to stave off impeachment of himself or any other official subject to impeachment.
6. But it is NOT clear that POTUS can't use pardon power to clear Jared, Ivanka, Dum Jr. Deripaska, etc., just because Pelosi starts impeachment. AND HOLY SH!T THE DEMS DID INTRODUCE ARTICLES ON IMPEACHMENT 1/3/19. Am I the only one that missed this?
7. So THE HOUSE has articles of impeachment. AND THEY'VE BEEN REFERRED TO THE JUDICIARY COMMITTEE. @File511 @lauferlaw @karolcummins @PNC16basses @WalshFreedom @AltNellGwyn @ninaandtito did y'all know about this?
8. Judiciary Committee referred to House Subcommittee on Constitution, Civil Rights and Civil Liberties. You know who is on that? @RepSwalwell

According to CNN Nadler is begging Pelosi to launch an impeachment inquiry in the House Judiciary Committee. WHERE THERE HAVE BEEN IMPEACHMENT ARTICLES SINCE JAN. 2019.
According to CNN, Nadler lobbied to open impeachment so he could have greater authority. AUTHORITY HE ALREADY HAS.
And let's get one more thing straight. ANY MEMBER OF THE HOUSE INCLUDING NADLER CAN INTRODUCE ARTICLES OF IMPEACHMENT WHENEVER THEY WANT or sign onto the ones from January. They could do so on the basis of what is in the Mueller report, if they want. SO THEY DONT WANT
And whatever is going on in DOJ/FBI/CIA/Spookworld (@20committee ) concerning the DOJ/Mueller's decision not to press forward (yet) with the prosecutions of Trump family members and similar bigwigs, has nothing to do with the fact that there are not Arts of Impeach in House.
So, as I started. IMPEACHMENT IS POLITICAL. If the DOJ was ready to prosecute, IT HAS A DUTY TO PROSECUTE as well as prosecutorial discretion to decline to do so under certain circumstances. I still believe that patriots are doing their thing in Pelosi's office AND the IC comm
