Epstein is a world class scumbag and his crimes were facilitated by current Trump officials. A Reading the News With Dirk Thread.
Since everyone was going crazy about Epstein supposedly getting off today, I decided to go to PACER and read the pleadings. The basic case is Jane Doe v. United States (The US is the Defendant, not Epstein) and the Jane Does challenged Epstein's sweetheart plea deal. In 2008.
Per the Crime Victim's Right's Act, victims are supposed to be notified in advance of plea deals and given an opportunity to challenge. Acosta (then US Attorney, now Sec Labor) hid the deal, shut the girls out, and the girls weren't even told case closed.
Current posture is that the trial Court (SDFL) found that the JD's rights had been violated by the US's failure to follow the Crime Victim's Rights Act, and asked the parties (including intervenor Epstein) to file briefs on "proposed remedies."
The CVRA is somewhat unusual in that while it provides procedures that must be followed, it doesn't state what happens if the procedures are not followed. They were NOT followed here, so the Court is going to have to decide what to do about that.
The Court's Order required the victims to file within 30 days of May 13. This pleading does not appear on the docket. The US's brief, however, is titled "Government's Response to Petitioner's Submission on Proposed Remedies", so apparently the prior pleading is sealed.
As an aside -- three cheers for these girls (now women) and their lawyers who have been fighting this fight for all of us since 2008. That is incredible fortitude in the face of what no doubt have been both major bribes (settlement offers) and serious threats.
Although we do not have the victim's brief, we have hints as to what is sought. The most contested is partial rescission (undoing) of the plea agreement.
The government admits it f'd this up, failed to communicate with the victims, and notes it's modern commitment to the victims of human trafficking. Nevertheless, it offers a pathetic set of remedies:
US DOJ PATHETIC OFFER: 1) Designate DOJ rep to talk to victims about plea deal; 2) victims allowed to make impact statement in court; 3) US Attorneys in FL Southern District would get more training on crime victims. This is WEAK.
The next several pages of the DOJ's brief state that there are no civil enforcement actions for victims under the CVRA. Presumably the trial court has already ruled that there is, since otherwise the Plaintiffs would have been out on Motion to Dismiss.
DOJ complains that the victims would like to eliminate parts of the plea deal, but keep others, since some provisions were a benefit to the women.
Many victims are prepared to assist the prosecution if it is restarted!
Bottom Line: Women would like to kill the plea deal and have Epstein prosecuted. Also apologies and other soft relief. So much is under seal that it is hard to evaluate what the Court may do. It definitely sounds like we will hear from at least some of the victims, though
Epstein is due to file a brief in a week. That should be interesting.
