Late last night I got a call from son of a detainee in Assam. Crying he told me that his name as well as that of his other family members have been removed from the NRC.
Let me tell you why this happened.
Since November the practice that has been prevalent in SC is that most
fresh matters against the FT orders were being admitted only if one or the other family members or the name of the petitioner himself was included in NRC. All the matters were tagged together and after a very very brief hearing SC passed it's judgment. That judgment paved way for
deletion of names of family members include in NRC. Around 1 lac more have been excluded. So now because the NRC number was readily available, the name of family members who found mentioned in NRC after tracing their lineage through family tree mechanism were also removed.
So instead of the rule that should be that if one family member, related by blood through father,is Indian then other member will obviously be Indian, the rule that is being observed is that if one is declared foreigner, the name of others will also be removed from NRC
The rule now is that there is a presumption of lack of citizenship rather than presumption of citizenship. This is contrary to legal principles. As per section 3 of citizenship act if a person is born before 1st july 1987 then he is automatically an Indian citizen.
No one is adhering to this law. I feel so helpless. Hum bachane gaye the logon ko, bache huon ko dubwa aaye. So when you guys were celebrating that small victory in case of that paralysed man in detention center, it was giving me jitters. I never wanted that to be a news
Because I don't know what will happen next. No one understands what will happen. There is a strong possibility of 40 lakh people being stateless. Do you understand the magnitude? This has never happened in history. I'm hopeless. Like @AmanWadud I'm also feeling lost
I have been to therapy because of these cases. My anxiety is killing me. I don't sleep peacefully anymore. It feels like I have disappointed those who had faith in me. Yes, as a lawyer I should not be emotionally connected with my cause but this is unfathomable.
I never imagined I would so closely witness this injustice. I am very very junior at the bar to have my voice matter but what about the doyens of bar. Everyone is silent. Don't they see it. No state does this to its own citizen. Worst, it's all court monitored.
NRC is nothing but culmination of tribal chauvinism and a disaster in making.
Assam is lost.
