Furlong mentions some reasons:

1. A 14-month delay. And Tommy has been of good behaviour since then.

2. Double jeopardy. By exercising his right to appeal, he's now in a worse position a year later. (Again, Americans, don't let this happen to you.)

5. A custodial sentence is not inevitable; and even if it is, it could be suspended, or combined with a financial penalty (Ezra's note: as every other journalistic case of contempt has been)
