Maharaja Hari Singh of Jammu and Kashmir accedes to the Union of India during Partition under terms defined under article 370 which gives the state a special status
The article starts with the words “Temporary”, “Transitional”, and “Special”- Provisions agreed to facilitate the smooth incorporation of the state of Jammu and Kashmir into the Union of India. NOT PERMANENT.
The provisions prevent anyone outside the state from buying land and settling in the state and ENTIRELY allows the state to define the permanent residents of the state and gives it autonomy in ALL matters except Defense, Foreign Affairs, and Communications
Fast forward to 1987-Violent Radical Islamic Insurgency movement springs up (which grips the state till date) driving out >150,000 Kashmiri Pandits (native Hindus). Local mosques issue declarations that the Pandits must either leave the state, convert to Islam or be KILLED.
Meanwhile the state is several decades behind the rest of the nation as economic activity-VIRTUALLY NO private investment and business infrastructure-is stagnated by the "special provisions" granted to the state.
This, coupled with radical ideologies and separatist movements, creates an optimal breeding ground for youth to JOIN violent radical groups
Some countries then actively resort to using this fragile environment to their advantage by waging a proxy war using TERRORISM as FOREIGN POLICY to exploit the situation and create further unrest
A vicious cycle of increasing military presence and increasing terrorist activity and radical ideology grips the region. INNOCENT Kashmiris suffer the most.
LONG overdue, after 70 years of a CLEARLY FAILING AUTONOMY, the government SCRAPS the article hoping to bolster infrastructure development, private businesses,& government and private investment from OUTSIDE the region-all building blocks to enhance the development of the region
To show the youth a better life and keep them from falling prey to radical ideologies and END the cycle of violence - and consequently military presence - to FINALLY put an end to the plight of the Kashmiris.
As for the TEMPORARY AND LEGAL increase of military presence, lockdown on internet services, and house arrest of some leaders- these were simply provisions to prevent VIOLENT protestors from assembling and causing unrest
Remember, the very concept of PEACEFUL protest does not exist here. Protestors infiltrated with terrorists REGULARLY carry out attacks on military personnel waving ISIS flags and others of globally recognized terrorist groups killing innocent people
In the world’s LARGEST *SECULAR* DEMOCRACY, home to the SECOND LARGEST MUSLIM POPULATION IN THE WORLD THIS IS NOT A GENOCIDE NOR AN “ETHNIC CLEANSING”. Just measures taken to PROTECT the local people from TERRORIST infiltrated protestors in a terrorist infiltrated REGION
The presence of such a vast number of troops required to simply SET A MOTION IN THE PARLIAMENT rather REFLECTS the dire situation in the state- how much terrorism and extremism have gripped the state and further justifies the need for drastic reform
As a result, ALL the government laws now apply to the state. Most notably those prohibiting Child Marriage and Protection of Women’s Rights (previously violating Muslim Personal law).
Not only did the article ENTIRELY ALIENATE the State of Jammu and Kashmir from the rest of India, it PREVENTED the State from INTEGRATING with the rest of India on a PHYSICAL, CULTURAL, SOCIOECONOMIC level defeating its SOLE purpose and GREATLY contributing to the situation today
To put it into perspective: In the TOURISM-CENTRIC state economy(J&K), 70 YEARS & NOT ONE MAJOR HOTEL CHAIN HAS BEEN SET UP! The Kashmiri people deserve better. Inclusivity and acceptance from both sides. A new dawn awaits them.
The actions are not the "Death Of Democracy". The decision was made through a democratic process in which some of Modi's biggest critiques overcame ideological differences to pass the bill with >2/3 majority making it one of the most unilaterally passed bill in the parliament
