1/ In a landmark decision that must be sending shivers down the spine of Silicon Valley, the Ninth Circuit today ruled that Facebook must face a class action suit claiming that its facial recognition practices violated an Illinois biometric privacy law

2/ This is a huge deal not only because it exposes Facebook to potential damages of several billion dollars.
3/ The Facebook facial recognition decision today is important because the court found that collecting the facial data of Illinois residents in violation of the state's biometric privacy law "injures an individual's concrete right to privacy."
4/ In other words, the court found that Americans' —or at least Illinoisans' — right to privacy can be violated even without a concrete physical or economic harm — like stalking, identity theft or financial loss.
5/ It's also a landmark decision because the judges ruled that the Illinois law gives Facebook users there "the right not to be subject to the collection and use of such biometric data."
Imagine a world where Americans had the right not to be subject to data collection.
This echoes a decision early this year in which the Illinois Supreme Court ruled that a Six Flags amusement park had violated the biometric privacy law by fingerprinting a child without consent.
In Illinois, unconsented biometric surveillance is a harm.
