I’m a bit out of my depth here, but I’m wondering about applying for a search warrant in the USVI
This is the DOJ office there that would make the ask

justice.gov/usao-vi
This is the court they would ask

en.m.wikipedia.org/wiki/District_…
This is the judge they would ask
So maybe it was a jurisdictional issue in part, and maybe they had applied previously and were turned down. I don’t know
This the current judge. An Obama appointee. Born and raised in the USVI

en.m.wikipedia.org/wiki/Wilma_A._…
Harvard grad. Don’t know a thing about her

Maybe they never asked before, which is weird

ali.org/members/member…
She was the US Attny for DC in 2000

washingtoncitypaper.com/news/article/1…
Trump has nominated her replacement

Not sure if he’s been confirmed by voice vote yet

I don’t think so

I don’t know if it would have made a difference know
So there was new case law as to search and seizure in the USVI

reason.com/2019/01/22/the…
Any appeals out of the USVI are heard in the third circuit
Meh. New case not on point. USVI has their own code of criminal procedure
Ok. Here are the USVI Rules for Criminal Procedure.

They’re in Exhibit A
Epstein was arrested in NYC on July 9th

thedailybeast.com/jeffrey-epstei…
They searched his home at the time of his arrest, they brought warrants
When you are lawfully arrested, the police can do a “search incident to arrest” of your person and the immediate area around you to insure you aren’t a danger and cannot destroy evidence

en.m.wikipedia.org/wiki/Searches_…
Once inside his home to lawfully arrest him, which happened in NYC, they can also seize items that are “in plain sight”

If you arrest a guy, and across the room you see a counterfeiting machine, it’s in plain sight. You can take it
In the NYPost story above, they make pains to say the detectives found a safe “in plain sight”. It was in the middle of the room

I think they didn’t expect to see a large safe in the middle of the room and it may not have been on any warrant they brought with them.
That’s known as the Plain View Doctrine. Personally, I don’t think it’s enough to let them bust open the safe without a warrant. They would have fought to suppress the contents of the safe at trail. He’s dead now so it doesn’t matter.

en.m.wikipedia.org/wiki/Plain_vie…
Most everything in the new indictment happened in NYC, and some in Palm Beach. I’ve only skimmed it, but thus far the indictment doesn’t mention the USVI

They didn’t alleged any crimes there in the indictment

documentcloud.org/documents/6184…
Now maybe they were planning to add the USVI stuff, once they had rolled a few of his coconspirators
But this new indictment only talks about NY and FL. Not the USVI

Interesting
The NYPost does mention a search warrant pursuant to his latest arrest. I haven’t found it yet. If any of you have. Give a shout

Ain’t too proud to beg
I forgot to link the USVI rules of Criminal Procedure!

Here. If you can’t sleep at night. Exhibit A

Search and seizure in USVI
Almost done. Isn’t this fun! No. No it’s not.

Next are the rules for seizure of evidence.
That’s it!
OK

THAT WAS REALLY DULL

Bottom line. Prosecutors only charged stuff in NY and FL

Not the USVI
Not in NM

Therefore, no search warrants executed at the time of his arrest for USVI and NM
I don’t know why no NM or USVI. NM wasn’t part of the first one either
Here. In case you want to join the prosecution of the co conspirators

And just for fun
No fed statute of limitations for child sex crimes
But. Maybe this is why not USVI charges

redstate.com/elizabeth-vaug…
And NM didn’t even make him register as a sex offender after the first case

lawandcrime.com/high-profile/p…
It appears Epstein had some NM patrons
