Thanks to CT #redflaglaw law an anonymous tip got a student at Central Connecticut State University arrested. He cannot post $250k bail until next hearing on Sep. 6th. will spend 21 days in jail after committing no crime.
The anonymous tip claimed Wagshol was interested in purchasing ammunition out of state. A legal exercise of interstate commerce.
Interstate commerce clause, 1st, 2nd, 4th and 6th Amendments violated by the State.
Arrested for lawful activity:
1A = arrested for posting a meme.
2A = legally owned firearms seized
anonymous tip leading to an arrest for lawful activity:
4A = no warrants shall issue but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched and the persons or things to be seized.
committed no crime but still arrested based upon an anonymous tip, and cannot confront his accuser.
6A = "to be confronted with the witnesses against him"
did the anonymous tipster have a nefarious motive for reporting Wagshol?
Did the anonymous tipster wilfully abuse the CT #Redflaglaw?
We may never know.
What exactly is Wagshol's remedy when the trial ends and he is free and firearms are returned?
He's been banned from campus
stigmatized as a potential mass shooter
will incur substantial debt in the form of legal fees
will have spent over 20 days in jail before posting bail
all from an anonymous tip and the actions of a state that will violate anyone's Constitutional rights in the name of "safety"
Ironically Connecticut is "The Constitution State"
