"#RedFlag" laws can be used to both seize the property of a citizen convicted of no crime & preempt their rights of self protection.
Hence procedural rights of the "accused" should exceed even those afforded in Miranda and the State burdened with "proof beyond reasonable doubt"
This includes the right of a person accused under a "#RedFlag" law to be "provided counsel if they cannot afford counsel", the right to request a trial by a jury of their peers and most importantly the right to face their accusers and have them cross examined in an open court.
Further, any Federal "#RedFlag" laws should mandate that perjury in testimony that could have denied a citizen their civil right of self protection will be considered an aggravating circumstance and remove any DoJ privilege to assert "prosecutorial discretion" in these felonies.
To wit, local, state, federal employees/officials & health care providers/clinicians found to have perjured themselves in "#RedFlag" cases, having been subsequently convicted of a felony would, in addition to their prison sentence no longer be employable in their former careers.
