I appreciate this article very much, @bariweiss, @PamelaParesky & Nadine Strossen. But I think there are several issues here that must be distinguished, in order to clarify the rights of the speakers, vs those who financially enable them, either voluntarily or through compulsion:

1) The natural right of the individual to speak his/her mind, no matter how offensive to others, so long as it does not involve incitement of violence against others.

2) The natural right of individuals, separately and collectively, to not be forced to provide money "for the propagation of ideas [they] disbelieve and abhor is sinful and tyrannical." - Thomas Jefferson

3) What rights said individuals possess, separately and collectively, if they live under a system that forces them to financially support all manner of speech to occur, mostly under the guise of "education," if said speech is:
(a) Inimical to their own, or which they know to be untrue
(b) Incites mass hatred against them because of their immutable or chosen characteristics

4) Under such a system, what guard rails must morally exist if the subsidized speech-makers are using those resources, and their power, to:
(a) Openly align with designated foreign or domestic terrorist organizations
(b) Are indoctrinating the young to believe lies, that lead them to also support such terrorist organizations

5) The obligations of a freely-elected government to ensure that our 5th Amendment protections are enforced, rigorously:

"No person shall...be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

Our taxpayer-funded institutions have not only failed to teach the virtue of freedom of speech to our young people, it has so confounded the issue that many if not most are openly hostile to it, or reject it.

Research I've compiled, here:


[3.6] 19% of American college students overall (including 22% of Republican students) believe it is “acceptable” to initiate violence to prevent a invited guest from speaking on campus, if his/her critics claim s/he makes “offensive and hurtful statements.”

[3.7] 38 percent of American adults think the First Amendment “goes too far” in protecting freedom of expression.

[3.8] 45% of Republicans believe courts should have the power to shut down media outlets for publishing “biased,” or “inaccurate” information, while 20% disagree; 18% of Democrats support courts shutting such outlets down, while 39% disagree; 43% of Republicans believe President Trump “should have the authority to close news outlets engaged in bad behavior.”

[3.9] 51% of Democrats, and 37% of Republicans support passing a law that would criminalize “hate speech,” meaning any statement or expression that a racial, religious, sexual or ethnic minority might find offensive; 40 percent of Americans between the ages of 18 and 35 support government censorship of “statements that are offensive to minority groups.” UPDATE: In March 2017, a significant portion of Georgetown University students, as well as its Saudi–funded “Bridge Initiative,” opposed and shouted down a former Muslim who was invited to speak, about her criticism of sharia law, claiming she was engaging in “hate speech.”

Where we are now, because of the rudderless, unprincipled "leadership" of so many private and public institutions, which surrender to the loudest mobs, is what is giving birth to the mass confusion over what the words "free speech" actually means, in a rational sense.

As a classic liberal, and the son of one of the last Jewish children the Nazis allowed to leave occupied Vienna, but also, I believe everyone legally standing on US soil has the natural right to say what they want, even to support anti-Semitic beliefs, if they want. But only so long as it is in their own capacity, using their own resources, or those that were voluntarily donated/given to them for this purpose -- and so long as it does not rise to the level of explicit incitement to violence.

Using this example, it is then the moral obligation of non-anti-Semites to use their free speech rights to denounce them, to show where such hatred leads, and to expose anyone who provides money or a platform to them, be they a soapbox orator or the head of a cesspool of anti-Semitic incitement, masquerading as a professional "news" organization -- as the @HuffPost sewer has done for more than ten years. (Here's the trailer of a 44-minute documentary I produced about this.)

Similarly, I believe no such right -- to incite anti-Semitism, or hatred or violence against anyone else -- exists within the taxpayer-funded public university or education system. Those schools have an obligation to establish and consistently enforce this principle.

These basic principles need to be articulated and championed, as the basic road map to living in a free society, and supporting and defending its principles.

Where we are now, because of the rudderless, anti-freedom doctrines of our federal and state governments, is a sort of moral quicksand, in which the most persuasive propagandists win the day.

We saw it with Trump, we saw it with Obama, and we're now seeing it with fervent supporters of foreign designated terrorist organizations, and their bloodthirsty, violent anti-Semitic savagery.

I don't know what the legal framework is, specifically, by which this should be addressed.

But I believe the overwhelming majority of Americans could be persuaded that neither they nor their backers have any right, and should have zero power, to force them (taxpayers) to enable them, under the guise of "freedom of speech."

Until and unless that basic principle is articulated, explained, and fervently defended, in terms that the average adolescent can understand, I don't see how we can survive as a free, self-governing, prosperous, secure nation.

The only real bright lights I see, in terms of forums and organizations that are interested in even having this discussion, are @TheFP @uaustinorg, @TheFIREorg @TheAtlasSociety, @AIFDemocracy and a few others. And particularly re @TheFP, I am very inspired to see that so many of those leading this donor revolution, including @BillAckman and others, are seizing this moment to articulate and exercise these basic principles, in our crisis situation.

Given that the average adult today has an initial attention span shorter than that of a goldfish (see 4/), however, I believe it all needs to be ultra-simplified, through Apple-level design approaches and spread like wildfire, by all people and organizations that believe in both freedom of speech and rigorous national security.
