If parliament threatened to remove this discretion from PM, I can imagine wise government lawyers advising the PM to request the extension rather than losing the discretion altogether.
And a sensible tactic of MPs in the next two weeks would be to seek to remove the PM's discretion on A50 extensions altogether, forcing government to make extension request this time just to retain the discretion
And if MPs are careful to structure legislation in terms of "vires" (ie, legal power) then there will not be a law for Gove etc to not comply with, but a removal of their legal power to do something - leaving them legally high and dry
