Client who is a disabled single parent told me last week how she is stuck in a cycle of pawning items from her home for money to tide her over until she gets her payments and then buying the items back. She's taken to pawning the Christmas gifts she bought her two kids. (1/6)
She showed me an organised folder of slips showing the items she's pawned along with details of the loan given and the last day she needs to pay the money to buy back the goods. Her stress is through the roof and she's in over £3,000 of rent arrears. (2/6)
All came about because the lifetime award of DLA she had was reassessed when she was "invited to claim" PIP and had her income reduced by over £300 a month due to her only being awarded standard rate care instead of high rate for both care and mobility. (3/6)
She waited months for an appeal and lost the appeal. I advised client to do a DPA subject access request and get a copy of all information and evidence as over years she had built up a large file by sending this to the DWP to support her claims. (4/6)
As I shared a number of months ago personally, the DWP wrote back to advise they'd destroyed her DLA file along with all of the paperwork she had sent over the years as she no longer had "a live DLA claim". Everything was lost. (5/6)
If you (are or) have a client transferring from DLA to PIP then you need to make a subject access request at the absolute earliest opportunity BEFORE the new application is considered as this seems to be routine and claimants are having to start completely afresh. (6/6)
To request information from the DWP you should complete the form here and stipulate what information you would like. You do not need to give them a reason and you do not need to pay any fee or administrative cost.
