If they are captured and have committed crimes, then yes, executing unarmed combatants without trial or executing a POW is illegal.
In order to provide someone with a fair trial, they are generally captured and unarmed at the point of the aforementioned trial. We either have grossly misunderstood your question or you need to provide the question in a different format.
OBL was unarmed at time of his death, and if the state wants to claim otherwise, we need further transparency regarding the raid and circumstances of his death. Given info points to summary execution, a int'l crime. Executing unarmed combatants is illegal.
It doesn't matter what we think, you can convince yourself that's what happened, but it won't make it any truer. There are laws and they apply to everyone, including terrorists, as do their protections.
Being pretty sure and actually knowing are two different things; ordaining the summary execution of someone or killing them based on self-defense have judicial consequences. Laws exist for all of us not just those we choose.
The legal system does not work through opinion and conjecture, it works through fact and evidence, as in there is video footage of the raid and witnesses which needs further inquiry. OBL was unarmed as far as the law is concerned unless proven otherwise.
