Good evening, Threadnought - New Filing!

This one's another notice of appearance. I don't usually livetweet these, but I've got a couple of things to say about this one.
This is yet another lawyer entering on Vic's side - Michael Martinez of Martinez Hsu.

What follows is my speculation, along with my reasoning.

tl:dr -
I think Ty is fired in all but name, and I think Nick is probably mostly out of the inner circle.
Here's my thinking on this:
(1) The case was never winnable, but it's so obvious that Ty took what little case there was and set it on fire that even a bunch of the Kiwi Farms people have figured it out, if even that pack of obdurate fools can figure it out, Vic might too.
(2) Mediation was a gift to Vic from Judge Chupp. And we know from the invoices that there was - at a minimum - an offer on the table from Funi.

That gift, too, was set on fire.
(3) We're in a phase of the litigation where all Ty and Nick can do for Vic is continue to make things worse. This is, granted, maybe the only thing that those two bozos are really good at - credit where due, they're truly excellent - but those services may no longer be required.
(4) The defense counsel had a month to polish the fees motions, and those motions were not complex. I think it's highly likely that although not all were filed in time to make it to re:Search Tx yesterday, at least one more would have been filed before Nick's stream last night.
(5) Nick - as far as I can tell from @WhippleMarc's thread - did not discuss the other motions. If he had seen them, that would be distinctly out of character for that nuclear-powered motormouth.
@WhippleMarc (6) I think @Tylerjswolff's initial guess - that Hsu was brought in to take a hospital pass at the TCPA hearing - was correct. But yesterday's filing was drafted by an associate from Hsu's firm. And now Hsu's partner, Martinez, has entered an appearance.
@WhippleMarc @Tylerjswolff (7) That's a bit beyond hospital pass territory, I think - especially since Martinez is a litigator. I think this is new team territory.

Especially since we've already seen that Ty doesn't play well with others - particularly in the courtroom.
@WhippleMarc @Tylerjswolff The initial "you should be standing" incident came when Ty couldn't keep his stupid mouth shut at the first hearing in the case. And Ty jumped in over Hsu at the TCPA hearing - when Hsu, while not doing a great job, was clearly far better than Ty.
@WhippleMarc @Tylerjswolff (8) If I was Hsu, I couldn't see bringing in more firepower unless Ty was firmly sidelined.

(9) With the recent major shakeup at the firm formerly known as BHBH Law, not to mention the bar complaint, Ty may have additional reason to sit down and STFU.

@WhippleMarc @Tylerjswolff I'll freely admit that there's a hell of a lot of speculation in there, particularly when it comes to Nick's level of access. But I think it's very likely that Ty is no longer the real leader of the Band of Buffoons, and that steps are being taken to distance Vic from Nick.
@WhippleMarc @Tylerjswolff The question is what effect, if any, this is likely to have on the fees and sanctions portion of the proceedings. And, of course, whether this will improve the outcome for Vic.

And there is still a path to victory for Vic.
@WhippleMarc @Tylerjswolff If, that is, "victory" for Vic is narrowly defined to include any outcome that limits his out-of-pocket liability to less than $500,000.
@WhippleMarc @Tylerjswolff If Martinez Hsu come in on Vic's behalf with an expression of contrite contrition for the miscues of former counsel and overly zealous idiots over whom Vic has no control at all, they might - just might - be able to minimize the sanctions.
@WhippleMarc @Tylerjswolff Of course, there's still an uphill climb there. Vic's deposition testimony regarding the GFM is unhelpful. The photo of the Three Stooges and Their Small Cigars is unhelpful. The selfie of Nick and Vic in Hawaii that was taken after the dismissal of most of the case is unhelpful.
@WhippleMarc @Tylerjswolff And, to be blunt, the decision to come in with that asinine sanctions demand yesterday is also unhelpful. Doubling down is not how one best expresses contrite contrition. Doubling down in a filing with no case cites is not how you distinguish yourself from Ty, either.
@WhippleMarc @Tylerjswolff Maybe the strategy is to show that they're still willing to fight tooth and nail in an attempt to get some kind of settlement offer back on the table from the defendants. But if so, they might as well have left Ty in place.
@WhippleMarc @Tylerjswolff So while I think Martinez Hsu is going to be the new face of Vic's legal team for whatever time this case has left, I'm not confident it will have much effect.

At the moment, it looks depressingly like a case of "here comes the new fool, same as the old fool."
