BREAKING: Judge Sullivan responds with a lengthy order to DOJ's motion to dismiss the Flynn prosecution and quotes the judge on Roger Stone's case. Order states that "at the appropriate time" he will set a schedule for the submission of any amicus curiae briefs. @CourthouseNews
Sullivan is clearly not happy. By setting a schedule for amicus curiae -- friend of the court -- briefs he's putting off responding to DOJ's motion to dismiss the Flynn case. In what would be a shocking twist, the judge can deny the motion.
Reminder, this is the judge who told Flynn back in 2018: "Arguably, you sold your country out.”
Sullivan quoted Judge Amy Berman Jackson on not allowing a free for all on "friend of the court" briefs in a criminal case.
