Help please. I have a 74-year old summonsed juror. He is self-isolating and due to pre-existing health conditions cannot use public transport. He has provided medical evidence, but the court bureaucracy is forcing him to attend.

What should he do?

Note that the government’s reaction isn’t an expression of shock that people have been fined for doing something that was always permissible. It’s to review fines lawfully levied - i.e. to change the law retrospectively to try to exculpate Dom.
The government is actually, seriously proposing to introduce retrospective legislation to create a new legal defence of Doing As Dom Did.

All to save a man who is such an irreplaceable genius that he held a press conference to inadvertently admit having committed an offence.
Given that, at its very height (and assuming you accept his inherently inconsistent account as truthful), his “defence” is “I did what was most convenient to me”, the scope of the Dom Defence is going to have to extend to many if not most people fined under the Regulations.

If the Attorney General @SuellaBraverman has been given that account, including the Barnard Castle eye-test, and feels able to advise the Cabinet with confidence that no breach has occurred, I would respectfully question her powers of legal analysis and judgement.
I mean, it’s one thing to abuse your office by advising on a private criminal legal matter as superintendent of the Crown Prosecution Service, but to get that advice so dreadfully wrong... that’s quite a day at the office.
Even if you thought that there might be an arguable defence worth running, there is no way that any criminal lawyer applying independent judgement could listen to those instructions and advise confidently that there has been no breach.

Anybody else uneasy about an elected Police and Crime Commissioner intervening in an individual operational matter in this way?
I’ll confess, I’ve never understood the argument for PCCs, but this does not tally with my understanding of their statutory functions.
Even if lawful and within the PCC’s remit, there is something unappealing about a criminal investigation apparently being directed by an elected official, especially in the context of a politically-charged case.

If anyone with expertise of PCCs can shed any light, please do.
