In addition to laying out how, exactly, this rule change would completely end the ability of an asylum seeker to seek even the most limited protection in the US, Luis also pointed out that there’s a potential consequence for DACA recipients down the line. 2/
Unclear what will happen at SCOTUS, but if DACA is canceled & a DACA recipient is put into removal proceedings, this rule wld make it so that, Luis says, “the judge can deny asylum applications summarily, cutting the only lifeline that most Dreamers have in immigration court.” 3/
Why might asylum be so important to a DACA recipient if he/she were to end up in removal proceedings? Luis: a draconian law passed in 96 (IIRAIRA) severely limited how someone cld apply for a “cancellation of removal.” Many Dreamers wldn’t be able to apply for such relief. 4/
Meaning that “many dreamers would have to depend on asylum,” according to Luis. It’s too early to say whether this will actually come to pass, & this is just one (of many) reads on the execrable new proposed rule change from the Administration. But worth adding to the mix. End/
