BREAKING: The US Appeals Court has GRANTED Flynn's motion to force Judge Sullivan to dismiss the case.

The three-judge panel's 2-1 rulin — authored by RAO — focused heavily on the "presumption of regularity" that attaches to DOJ actions, and notes that the new evidence submitted by DOJ, which led to move to dismiss charges, should be treated as good-faith.

Notes indicate Biden mentioned the Logan Act, but entirely devoid of context.

NEW: Flynn wins this round of Appeals Court fight to dismiss his case, but main question is what Sullivan does next. He could appeal to full court en banc (and would likely get a more favorable reception).

As @joshgerstein reminds me, Sullivan doesn't actually need ot do anything. Any sitting judge on the D.C. circuit could ask for a poll of the full court, and that could essentially sideline today's ruling.

Strzok's notes don't tell us much about a meeting we already knew details of. They suggest Biden said the words "Logan Act" and that Comey said the words "but appear legit" in the context of the Flynn-Kislyak calls.

Unclear who gave Strzok this readout of the meeting.

@joshgerstein INTERESTING: Gleeson was due to file a brief in the Flynn case today, and notes in a filing that the Appeals Court order doesn't take effect for 21 days.

But he wants clarification so as not to disrespect the Appeals Court decision.
