In the inbox: Bayer just announced it has cut a ~$10 billion deal to resolve Roundup litigation over claims the herbicide causes cancer.
The deal would resolve approximately 75% of the current Roundup litigation involving ~125,000 filed and unfiled claims, according to Bayer. It includes all plaintiff law firms leading the MDL and state California bellwether cases, and 95% of cases currently set for trial.
Under the deal, Bayer would pay $8.8 billion to $9.6 billion to resolve the current Roundup litigation, and $1.25 billion to support a separate class agreement to address potential future litigation. The 3 cases that have gone to trial and on appeal aren't covered by the deal.
Bayer also agreed to pay $400M to resolve a Missouri MDL over claims that Monsanto's dicamba herbicide drifting from nearby fields decimated adjacent crops. The only case to go to trial - which resulted in a $265M verdict Bayer will likely appeal - isn't covered by the deal.
Bayer’s Roundup deal doesn’t appear to include any agreement about label changes. It does, however, include setting up a “Class Science Panel” to determine if Roundup causes cancer. I have so many questions.
But wait, there’s more. Bayer also agreed to pay $650 million to resolve PCB litigation.
I don't think I've ever seen a press release announcing so many different settlements that would resolve hundreds of thousands of claims in multiple MDLs and consolidated state cases in one fell swoop.
