All four liberal justices dissent.
Remarkable and disturbing that the politicization of COVID seems alive and well at America's highest court.
A word about the dispute: in challenging the absentee-voting accommodations, Alabama relied on Purcell v. Gonzales, a ruling that says courts should not ordinarily intervene in voting matters so close to an election as "voter confusion" may result...
...This was the crux of the reasoning SCOTUS used in April when rejecting a lower-court accommodation in the Wisconsin primary. Dozens of in-person voters in the WI primary were subsequently sickened with COVID.
The conservative majority at SCOTUS seems to value a formalistic rule about late-breaking voting changes over accommodations to expand voting opportunity in an unprecedented public-health crisis.
One more note: justices who disagree with an order in an emergency application are free to keep quiet about that or note their dissent publicly. Justices Breyer, Ginsburg, Kagan and Sotomayor all chose to make their dissent public.
Why didn't one them write something to explain their disagreement?
