Too late, too little and too weak. That’s how I describe the DOJ-led panel that purportedly reviews the police killings in Duterte’s so-called war on drugs. [1/21] Image
The formation of that inter-agency team was announced by Justice Secretary Guevarra, as the representative of the Philippine government, in response to the reports and statements made during the ongoing 44th session of the UN Human Rights Council (UNHRC). [2/21]
Too late. The move is nothing but Duterte’s last-ditch attempt at throwing a monkey wrench to derail the work of the UNHRC and the International Criminal Court (ICC), through its Prosecutor, which are both being nudged by the UN High Commissioner for Human Rights [3/21]
and a number of UN Special Rapporteurs to formally investigate the extra-judicial killings (EJKs) in Duterte’s “drug war” and other cases of gross violations of human rights in the Philippines. [4/21]
In her report to the UNHRC, the High Commissioner found that there is no rule of law and due process in the so-called “war on drugs”, and that there has been a failure of domestic mechanisms to ensure accountability. [5/21]
In Dec. 2016, I submitted to the Senate my dissenting report on the EJK probe, where I recommended, among others, the immediate establishment of an independent national investigation to be led by respected former SC justices. My recommendation fell on deaf ears. [6/21]
Earlier, in September of that same year, I introduced a proposed Senate resolution urging the Duterte administration to invite the UN Special Rapporteur on Summary Executions to conduct a country visit. Again, my proposal got nowhere. [7/21]
Meanwhile, in a Jan. 2019 study by Rappler of available PNP and DOJ data, it was found that the PNP did not at all investigate the 5,050 deaths from their own drug operations, citing the presumption of regularity and the infamous “nanlaban” doctrine. Of the 20,000 or more [8/21]
total deaths that resulted from the war on drugs, DOJ has only prosecuted 76 cases. In April 2019, FLAG reported that their review of an initial batch of 29 EJK cases showed a lack of genuine effort on the part of govt to investigate the incidents & to arrest the killers. [9/21]
Too little. The work of the DOJ-led panel is circumscribed by its mandate to only review the killings by the police during their operations. It does not cover the killings done by other State-inspired death squads, the vigilantes. [10/21]
It does not also touch on other egregious crimes, such as torture, arbitrary detention, sexual assaults and others, that have been committed in Duterte’s “war on drugs”.

And, speaking of Duterte, he is instantly off the hook here, as he— [11/21]
along with the co-architects of the drug war, and other masterminds of the mass murder of poor drug suspects— is not within the ambit of the panel’s review. An independent body of higher mandate, and not Executive-controlled, is what is called for. [12/21]
Too weak. In SOJ Guevarra’s own words, the panel will conduct a “judicious review” of deaths during police ops. This “review” is definitely not the preliminary investigation that DOJ regularly conducts on criminal cases, not even evidence-gathering or case build-up, that [13/21]
can lead to prosecution of the accused in courts. Primarily, the reviewing panel “re-evaluates cases and examines the propriety of reinvestigating them.” This is a circuitous and cumbersome exercise that nowhere amounts to a formal investigative or prosecutorial process. [14/21]
In short: a shallow and listless initiative.

This is not even the first time that the Duterte regime proposed something to make it appear that they’re addressing the EJK issue. [15/21]
Then SOJ Vitaliano Aguirre announced the proposed creation of a specialized office for extralegal killings during the congressional hearings for the 2018 budget. Something that never materialized. [16/21}
The International Covenant on Civil and Political Rights (ICCPR) imposes upon all State-Parties, which include the PH, the “general obligation to investigate allegations of violations promptly, thoroughly and effectively through independent and impartial bodies.” [17/21]
In all the four (4) years that Duterte has been in power, there has never been any prompt, thorough and effective investigation of EJKs and other rights abuses. No independent and impartial body conducting such a probe. [18/21]
It is clear that this government has been in serious breach of this international obligation. No amount of obfuscation, disinformation and propaganda can change that fact. [19/21]
Unless and until we see any actual, significant and concrete achievements, in terms of case build-up and prosecution of EJK offenders, the sincerity of this initiative will remain dubious at best. [20/21]
For the moment, this representation will just call it as it is: a desperate, last-minute attempt at evading accountability. [21/21]

Regardless, BBM is not bound by such a secret agreement. A president cannot be bound by agreements secretly entered into by a predecessor for the simple reason that he has no way of complying with an agreement the details of which are subject to the recollection of those (2/4)

The 2nd installment of Arturo Lascañas’ interview on Vera Files is as shocking as the first part. In part 2, Lascañas goes on to describe how Duterte planned the assassination of several prominent personalities: Fr. Pete Lamata of Davao City, Ozamis Mayor Aldong Parojinog, (1/8)

China says refurbishing our post at Ayungin Shoal is a violation of their sovereignty and int'l law. We know China is lying when it claims sovereignty over Ayungin Shoal bec. Ayungin is neither an island susceptible of a terrestrial claim nor anywhere near China to be (1/10)
claimed as part of its EEZ. Ayungin is a marine feature below low tide elevation & well w/in our EEZ.

Besides, if Ayungin is truly a part of China, they won't waste time issuing public releases about their claim of sovereignty. They will just use outright force to oust us (2/10)
like they would w/ any real territory of China, say like Hainan.

The fact that China is not treating Ayungin as it would Hainan, i.e, with an outright expulsion of Philippine forces and the destruction of BRP Sierra Madre, only means that they know that they have no right (3/10)

Are they afraid of the Truth? Why are they blocking it? DOJ’s refusal to transfer 11 inmate-witnesses in my last remaining drug case from Sablayan to NBP only shows the agency’s continuing attempt to stand by its former secretaries’ (Aguirre & Guevarra) bogus charges vs me.(1/12)
Until the very last moment, this agency which I also led for five years opposed my application for bail, despite its willful and deliberate use of manufactured evidence and perjured witnesses just to sustain Duterte’s persecution cases against me.

Now, DOJ wants the (2/12)
truth-telling by these witnesses to be made more difficult, by keeping them isolated & almost inaccessible from the hills of Sablayan Penal Colony in Mindoro, if only to prevent them from divulging who among DOJ officials, past & present, connived & conspired to fabricate (3/12)

6 years of unjust detention.

6 years that my persecutors hoped would be spent in futility, submission and silence.

Instead, it has been 6 years of fighting the good fight... perhaps the most important 6 years of my life.
When they thought I would buckle under the pressure of their oppression, I proved that my commitment to the Rule of Law, to Human Rights and, specifically, to speaking up for the victims,
mostly poor and defenseless, of the so-called "War on Drugs", is stronger than any wall they can put between me and the outside world.
