faced by the Provincial Civil servants and the proposed Civil Service reforms.

The forum was informed that reforms need to be undertaken based on the Constitution and sub-ordinate Laws. Article 240 (a) and (b), enunciates separate Federal, All Pakistan and Provincial

civil service. Federal subjects are dealt by the Federal legislative list part-1, All Pakistan service comprising joint matters under CCI come under the ambit of Federal legislative part-2, whereas provincial services is exclusively for all the provincial subjects & departments

there under. The federal & All Pakistan services are to be dealt by the parliament and managed through federal Govt and the CCI respectively, whereas provincial services are dealt by the provincial assembly and provincial Govt.

The present arrangement is illegal and highly

discriminatory. Federal employees supposed to manage the federal subjects have grabbed purely provincial positions in large chunk through an illegal Apportionment formulae '93. It is a violation of constitution, undermining of the Provincial assembly, CM/ Cabinet and

discriminatory towards the Provincial Civil Service. The secretary Estab. Division informed that about 700 positions in the share of PAS will be surrendered to the PMS at provinces as they are lying vacant. Also that a significant share will be given to PMS and the process

is underway.

We appreciated the measures, however it was emphasised that temporary measures won’t settle the underlying structural issues unless the administrative federalism is not ensured through above measures. It was stated by the forum that national integrity requires an

All Pakistan Service with officers having experience of different provinces, yet it was informed that the present arrangement is in fact harming the national integrity as it’s a bottom down mechanism where centre occupy the provinces through PAS, whereas genuine integrity is

bottom up which means that provincial officers will equitably manage the federal matters by enrolling at provinces and deputed to the centre . The performance based reforms were appreciated and even the need for functional Specialisation, NES and PES, yet it ought to be based on

the above legal provisions and principles of federalism. The chair assured that the matter will be taken into account and that we will have further engagement for an inclusive civil service reforms. Meeting ended with a vote of thanks from and to the Chair.
