Following up on yesterday's filing from Trump's lawyers in the NY grand jury subpoena case making clear Trump plans to keep fighting post-SCOTUS (see: ), there was a hearing this morning. It just ended, here's a thread summarizing what happened:
The one concrete thing to come out of today's hearing is that SDNY Judge Victor Marrero adopted the schedule that both sides proposed — Trump's amended complaint is due July 27, the NY DA's answer/motion to dismiss is due Aug. 3, and briefing on any motion will conclude Aug. 14
The lawyer from the NY DA's office, Carey Dunne, made clear that this schedule was a compromise, and that they want a resolution as quickly as possible. They contend any amended complaint will be facially deficient. He concluded by saying his office's position is: "Bring it on."
Trump's lawyer William Consovoy confirmed they haven't decided what args to raise in an amended complaint. They still contend the subpoena is not tailored to the DA's investigation, and again brought up the fact that the subpoena mirrors those issued by Congress to support that
One area of dispute is whether Trump's lawyers can conduct discovery. Dunne said no — that Trump doesn't get special treatment to contest a grand jury subpoena, and normally there isn't discovery in these types of cases, it's about whether a GJ subpoena is unlawful on its face
Trump's lawyers contend that to the extent the DA files an answer to the complaint, or loses on a motion to dismiss, the next step would be discovery. But that doesn't appear to be something Marrero will need to resolve right now.
Consovoy said they expect the focus of the amended complaint to be different than before. Dunne said that given that nothing has changed in the year this case has been pending, they doubt Trump can make args (i.e. about bad faith) that haven't already been considered and rejected
Dunne's overarching argument was that this is now about how long Trump can use the litigation as a way of delaying the grand jury getting these documents. He noted it's not just about Trump, but other individuals/entities under criminal investigation.
That's all for now. To recap, the grand jury in NY is not getting Trump's tax returns for now. The next step is Trump filing an amended complaint by July 27, and then we'll see what his legal strategy is in renewing his challenge to the subpoena.
