@lawyer4laws I’m interested in your thoughts. I think the President has the statutory authority to deploy the Nat’l Guard over the objections of local official pursuant to his authorization from Congress under the Insurrection Act.
While Congress has enacted various posse comitatus restrictions on the military, there are a number of exceptions, especially when it comes to the Guard. Plus, nothing in the Constitution expressly forbids the President’s action.
To me, this seems like a classic setup for Category-1 case under Youngstown Steel. 

BUT to me, the million dollar question isn’t whether the President can act, it’s whether he *should* act.
I question whether the rest of the country bailout these communities, especially when local officials don’t want help.
Elections have consequences. If you vote in radical left politicians, you’re going to get radical left polices. Shocker! To me, that’s on you — the voters — who elected the radicals.
Ask yourself...why are there no major recall efforts going on in these cities??? 

Is it because the efforts are not being reported? Maybe. There is a lot of #fakenews

But it could it be because the voters acquiesce to the riots and radical polices???? 🤔
Federal troops would bring short-term peace. Good. But what Portland needs is a change of heart and mind. Troops won’t do that, but reaping the consequences of your poor voting decisions might.
Don’t get me wrong, I’m big Law and Order guy. But I think Trump’s “not going in until asked” is the best play if you want lasting peace. You need buy-in from the community, and my sense is Portland isn’t quite ready for peace yet.
Ultimately, it seems to me that the voters in #Portland are getting exactly what they voted for — radical left polices.

Defend federal assets in Portland, but otherwise, I say let Portland have at it until they ask for federal help.
