Note that the word “force” appears four times in the text. Force is central to a conviction under 18 U.S. Code § 2384. Seditious conspiracy. Without being able to prove that force was used, a conviction for sedition fails. Have the protesters used force? Of course they have.
So, convicting them would not be hindered by the failure to prove that element of the offense. But what about @Shem_infinite’s question?
@Shem_Infinite Have the intelligence officials that tried to overthrow Trump use force? No. So, charging them with seditious conspiracy would fail, because the element of force cannot be proven. But what about treason? Surely they can be charged with treason?
@Shem_Infinite Whenever you seek to convict someone of a violation of criminal laws, you have to prove each and every element of the offense. Did the coup plotters levy war against America? No, not in the legal sense. Did they adhere to America’s enemies? Arguably no.
@Shem_Infinite I suppose you could make a case that they collaborated with Russia, but that would be difficult to prove in court. So, despite the hopes and dreams of many Americans, no coup plotter is going to be charged with treason or sedition, because the elements cannot be proven.

law.cornell.edu/uscode/text/18… Again, it requires the use of force. The coup plotters didn’t use force. They used deceit, subterfuge, conspiracy, falsification of official records, misuse of office, etc. but not force.

@Shem_Infinite I could go on, but you get the idea. There are plenty of crimes that were committed that could put the coup plotters away for a long time. We don’t need to charge them with treason or sedition, crimes for which they would probably not be found guilty.

Thread: When @atensnut tweeted this, she expressed the frustration of millions of Americans, including me.
@atensnut The reason Americans are frustrated is two-fold. First, they see very little being done to stop the riots in many places. People are arrested, released on bail, and return to riot the following night. It’s an unending cycle with no apparent resolution.
@atensnut Law-abiding citizens see it as an affront to our nation. We’re supposed to be a nation of laws. Yet, lately, it seems the law is most often honored in its breech. And it’s a reminder of our two-tiered “justice” system where leftists can do anything they want without consequences.

Thread: I’m so tired of political hypocrisy. Never was it more obvious than in the RBG situation. Both sides have obviously flipped their arguments completely. It makes both sides look petty and venal. The proper argument THEN is the same argument NOW.
When Merrick Garland was nominated, as was appropriate for the President to do, the Republican’s argument was, we should wait for the people to decide who the President will be. That was a bogus argument THEN and it’s a bogus argument NOW.
The correct argument THEN is the same argument NOW. The President nominates. The Senate confirms. When Obama nominated Garland, Mitch McConnell SHOULD have said, we are not going to confirm his nominee. Period. Because Mitch said, let the people decide, we are where we are now.

Hey .@TwitterSupport, .@Jack, do your rules include you not even having to tell someone WHY you blocked their account? You blocked mine and gave me NO reason at all, and didn't respond to my appeal except to tell me you were looking at it.
Notice how you never told me WHAT rule I violated or WHAT tweet violated your rules? Specifically for WHAT?
You didn't tell me in email. You didn't tell me on the web. You didn't tell me when I appealed. How in the world am I supposed to follow your rules if you won't even tell me WHAT rule I have violated?

Thread: Saturday evening Bible thread Our best friend is fighting cancer right now. This is her second time. She had lung cancer and beat it. Now she has a brain tumor and tumors on her lung and kidney as well as lymph node involvement.
From a sense knowledge viewpoint, this is terrifying. But, we don’t operate with sense knowledge. We’re Christians. So, we turn to God for help. I’ve been praying a lot lately. Not just in the way that many of you think, by speaking words and asking God for healing.
I’ve also been speaking in tongues a lot more, focusing on her, and others that I care about. This is a topic that can be very controversial. Many people believe that the powers that were acted upon in the first century are no longer available.
