cole white, a member of the violent white supremacist group the rise above movement, pleaded guilty almost immediately after being charged for his role in the violence of the unite the right rally & has been home with his family awaiting sentencing, which is happening now.
AUSA chris kavanaugh is asking for a downward departure on the sentencing guidelines for cole white due to his enthusiastic cooperation in building the case against daniel "jack corbin" mcmahon.
kavanaugh says cole white wanted his cooperation with the government against his fellow white supremacists to be public, as part of his leaving the movement. "he wanted it to be known far and wide" that he was denouncing his former lifestyle & testifying against former friends.
"he said he knew that on the day of august 12th, anybody who wasn't with them... they were gonna get it," kavanaugh says of cole white's statements to the government about the premeditated violence by white supremacists at the unite the right rally.
other members of RAM preserved their right to appeal on the constitutionality of the riot act as part of their plea deals, kavanaugh says, but white waived all right to appeal, which he says is a mark of his acceptance of responsibility.
kavanaugh says 12-18mo is appropriate. because white has already served 9 months, federal guidelines would allow half of the remaining sentence to be served on home confinement.
there isn't much for defense counsel to say - the government made a pretty enthusiastic argument for very little punishment for the defendant.
defense says he's done "exceptionally well" out on bond - working & going to school, completing his BA degree.
"he's been remorseful, he's been absolutely totally cooperative," cole white's attorney says of his client's behavior since being charged under the federal riot act for violence committed at the 2017 nazi rally here in charlottesville.
judge moon grants the downward departure in offense level (federal sentencing is based on a weird complicated rubric)
before his sentence is pronounced, cole white says: "i know you've heard this hundreds of times before, but i'm not the same man today as i was" at the time of august 12, 2017
cole white says "rather than spending my time in jail being angry and shifting the blame to others," "the 7.5 months i spent in jail allowed me to become a better person"
having renounced his former ties, he's now embarrassed and ashamed to have been a part of it.
judge moon sentences cole white to a total term of 14 months. he has already served 7.5 months in jail and the judge gives him 5 months credit for the time he's spent on home electronic monitoring since being released on bond last year. that leaves 2 months more home confinement.
cole white will not have to return to jail for any further incarceration but will remain on probation for 2 years after his term of home electronic monitoring ends in a few months.
the mandatory $100 special assessment has been waived due to the court's finding that he is unable to pay a fine. as a condition of the plea agreement count 2 is dismissed (not sure if that's the riot charge or conspiracy to riot charge)
and that's it. (former?) nazi sentenced.

you know how i keep my watermelons on the living room floor? i mean, they just end up there when i bring the groceries in. they’re heavy and what difference does it make if it’s there or on the dining room table or whatever?

happening now: activists from NC who participated in a demonstration outside the henrico home of ICE director tony pham are turning themselves in at the henrico county jail. they are charged with misdemeanors like littering and trespassing.
“i’m mad that i’m here - there are a lot of things other than this that we could be doing,” says nancy, one of the nine people here to turn themselves in.
last week, armed officers entered her home in pennsylvania and arrested her while she was changing her baby’s diaper. she was held for 21 hours. on a misdemeanor charge for participating in a protest here in virginia.

here's the agenda for today's meeting of the charlottesville historic resources committee.
there are 13 commission members, staff, and city officials on the call and 6 members of the public. there is some kind of power outage affecting a swath of downtown, so that could be affecting people's ability to attend, but 6 attendees is actually more than usual.
time has lost all meaning but i *THINK* this is the first virtual meeting of the historic resources committee? have they really not met since before the pandemic started?

we've got police chief brackney, city attorney lisa robertson, & acting city manager john blair on the call tonight.
board members deirdre gilmore and dorenda johnson are absent during roll call. stuart evans quit a few weeks ago.
ms johnson is apparently having technical difficulties and will try to join by phone.
(i'm not sure if there's maybe some audio delay on his end causing this to happen by accident, but board chair james watson is interrupting people pretty much any and every time any other person is talking)
