Those weapons have definitely not shown up in charging doc yet.
But...pay attention to 21-cr-35 in DC, a partly sealed indictment w/at least 3 named defendants, according to magistrate's files: Peter Stager, the flagpole beater; Jeffrey Sabol & Michael Lopatic Sr. (????)
When you look up Lopatic, for example, you find a newly filed detention memo saying that he not only punched a cop repeatedly, but stole body camera of another cop and disposed of it, destroying evidence, prosecutors say.
Mr. Lopatic...
Yikes.
One day after Election Day, Michael J. Lopatic of Pennsylvania, who has been charged w/assaulting a cop in the Capitol attack, posted a photo online of two dead pheasants he'd just killed (w/ head shots.)
"I named them Joe and Kamala," he wrote.
Double yikes.
In the days after Election Day, Lopatic killed more birds, naming them after Chuck Schumer and Nancy Pelosi...
In new court docs prosecutors say William Chrestman, a leader of the KC Proud Boys, confronted cops at the Capitol saying, “You shoot & I’ll take your fucking ass out!”
Chrestman also tried to stop cops from arresting a fellow rioter & armed himself w/a wooden club or axe handle.
When the FBI surveilled Chrestman in KC, they found he removed the address numbers from his home. Prosecutors say he also purposefully got rid of his firearms before agents executed a search warrant on the home.
This one bears repeating:
The leader of a Proud Boy group from Kansas City charged in the Capitol riots apparently thought he could keep the FBI from executing a search warrant on his home by...removing the address numbers displayed outside the house.
Prosecutors have filed new charges against Jon Mellis (in the hat below), accusing him of attacking cops at the Capitol with a stick. Mellis also rebutted the argument that Antifa was behind the attack, saying in a FB post "We proudly take responsibility for storming the Castle."
Arguing for his freedom pre-trial, KC Proud Boy William Chrestman says he has "experienced the clarity of perspective sometimes imparted by a federal prosecution."
Chrestman now realizes the Proud Boys are "radioactive," "enfeebled" & "in disarray," his release memo says.
Like so many others, Proud Boy William Chrestman blames Trump for his role in the Capitol riot. His plea to be released quotes McConnell's post-impeachment speech.
"The people who stormed this building believed they were acting on the wishes and instructions of their President."
After Chris Grider went home to Texas from the Capitol riot (where he was near Ashli Babbit when she was shot), he told his wife to "get rid of his Trump things," new court papers say.
His wife gave a Gadsden flag and red ballcap Grider had at the riot to a neighbor.
NEW: Prosecutors have unsealed an indictment against three men who violently attacked cops at the Capitol. All three--Jeffrey Sabol, Peter Stager & Michael Lopatic--had been charged separately at first. But the new indictment brings their cases together.
New charges have also been filed against Christian Secor, a UCLA student & founder of an America First campus group.
A tipster told the FBI that Secor is a Groyper, a reference to the white nationalist group led by Holocaust-denying podcaster Nick Fuentes
Secor also goes by the name "Scuffed Elliot Rodger," according to the tipster. Rodger, recall, was the incel serial killer who went on a shooting rampage in Isla Vista, Cali. in 2014
Secor's charging documents include a photo of him w/Nick Fuentes whose face is blacked out here and who is ID'd in the docs only as Person 1.
Still, if you're Nick Fuentes, it's not a good sign that the FBI is including you in criminal court filings.
The FBI says that Secor's Twitter feed encourages people to watch Nick Fuentes, describes fascism as "epic" and valorizes the Charlotteville tiki torch march where people chanted "Jews will not replace us!"
Somehow I missed this photo of Gina Bisignano, the Louis Vuitton-wearing salon owner from Beverly Hills who was charged w/storming the Capitol. It was included in a govt detention memo last week. The feds say it captures the moment Bisignano's makeup ran after she was tear gassed
NEW: Two weeks after executing a search warrant against him, the feds have unsealed charges against David Blair of MD. He's accused of attacking a cop at the Capitol with a lacrosse stick flying a Confederate flag.
Interesting: During the search of Blair's home in MD, the FBI found a notebook. Inside, under the words "SAVE USA," was a cryptic reference to Officer Brian Sicknick being a COVID victim. Agents also found an AR-15 and brass knuckles w/a confederate flag logo.
A prosecutor just said that the government is not seeking pre-trial detention for David Blair, charged w/attacking a cop at the Capitol w/ a lacrosse stick flying a Confederate Flag.
When Colorado congresswoman Lauren Boebert tweeted "Who is going to be in DC on 1/6 to stand w/President Donald Trump?” Glenn Wes Lee Croy (below right) answered, “Fellow Coloradan we will be there,” according to his criminal complaint.
The news is that a federal judge in DC has ruled that Eric Munchel, aka Zip Tie guy, should be held in custody pending trial.
But I still love the detail that before storming the Capitol he worked at Kid Rock's Big Ass Honky Tonk and Rock 'N' Roll Steakhouse.
It was probably not the brightest thing when Suzanne Kaye of Fla responded to a call from the FBI asking about the Capitol by posting a vid on FB titled "Fuck the FBI!"
In it Kaye said she'd exercise her “2nd amendment right to shoot your fucking ass" if the agents came to visit.
Proud Boy Dominic "Spaz" Pezzola is ready to enter plea negotiations to resolve his role in the Capitol assault, his lawyer says in new court papers released tonight.

Interesting: Judge Cannon has told the defense and govt to file proposed jury instructions defining the terms of the Espionage Act disputed at last week's motions hearing and narrowing the Presidential Records Act claim by April 2.
That suggests...
at least in theory that she is intending to take Trump's classified documents case to trial.
It would seem (?) like a waste of time to ask the parties to define for the jury the disputed elements of the Espionage Act--i.e. the law's requirement that the govt prove Trump had "unauthorized possession" of docs related to "national defense"--if she wasn't picturing a trial.
JUST IN: Alexander Smirnov told the feds during an interview after is arrest that "officials associated with Russian intelligence" were involved in passing a story about Hunter Biden.
Smirnov also reported to the feds having contacts w/some pretty shady Russians including one connected to what seems like an assassination crew and an intel guy.
Now: The first Trump documents hearing in front of Judge Cannon in Florida has ended w/o a decision on the trial schedule. Cannon seemed skeptical of the govt’s request to go to trial in December but also seemed disinclined to let the trial stray until after the 2024 election.
Cannon pressed Trump’s lawyer if they wanted to delay the trial after voting and they affirmed they did. They said if a trial date must be set it should be for mid-Nov 2024.
Cannon said she would file a written order promptly.
Beneath the scheduling issues was a fascinating philosophical discussion of the nature of Trump as defendant. It revolved around the question of should Trump be treated like any other defendant or did his role as candidate need to be taken into account .
Now: DOJ responds, glancingly, to the uproar over the Jacob Chansley footage, clarifying that the images of him w/the police took place *after* he illegally entered the Senate gallery--the behavior that triggered his obstruction of Congress charge.
By glancingly, I mean prosecutors responded to the complaints of another defendant, Dominic Pezzola of the Proud Boys, about the footage, and clarified their position on the new video.
"In sum," prosecutors wrote, "Chansley was not some passive, chaperoned observer of events for the roughly hour that he was unlawfully inside the Capitol."
We've just received more information about the tantalizing FBI data snafu that temporarily paused the Proud Boys sedition trial late week for an evidentiary
A quick thread.
Background: The dispute concerns a log of internal FBI chats from one of the case agents, Nicole Miller. The log was given to the defense for impeachment of her testimony. Miller minimized or hid responses from other agents since, govt says, they were outside scope of cross-ex.
But the defense found the minimizations & opened them up. The newly opened messages had some tantalizing things from another agent who was writing to Miller. There were also some places where Miller's responses to that agent appeared to be missing.
Update: Prosecutors have told the judge in the Proud Boys sedition case that the Jencks issue may have been a result of a "spill" of classified information.
No one seems to know exactly what that means at this point.
Jocelyn Ballentine, the prosecutor who oversees the J6 conspiracy cases, tells Judge Kelly that the spreadsheet of internal FBI comms at issue here contained classified messages from "one other agent who does clandestine work" but who did not take part in the Proud Boys case.
The Proud Boys trial data issue is threatening to spin off into true chaos.
Norm Pattis, lawyer for Joe Biggs, is calling for the appointment of a special master to examine the spreadsheet of internal FBI comms to check for any classified messages.
(Gonna say that's unlikely...)
