DOJ's brief in the E. Jean Carroll case has divided legal experts. But many of them are coming to Garland's defense.

“DOJ is not trying to save Trump, but protect a strong presidency and executive branch," says Biden transition lawyer @AndyMcCanse.
It was one of two recent cases in which DOJ angered liberals by taking a stance shielding Trump/Barr.

But @BradMossEsq says he understands DOJ's thinking.

"What we are seeing here is the department making decisions in these cases the way it is supposed to be done,” Moss said.
“Everyone is upset about the facts of this case, which is understandable, but Garland has to think about the precedent he is setting for everyone,” says @RDEliason.

Garland wants to avoid a precedent that makes it easier for future officials to get sued, Eliason says.

New: Derek Chauvin has asked a judge for a reduced sentence, saying prison will inflict "long-term damage" on his "life prospects."

One of Derek Chauvin's post-trial arguments is that juror Brandon Mitchell, pictured below, was biased.

Mitchell has called George Floyd a "legend" and a "martyr" during media appearances.

Interestingly, Dominion Voting now says it's possible Mike Lindell is a "cunning salesman" who doesn't actually buy his own claims but wants fame and money.

On the contrary, he and his company "promoted the inherently improbable Big Lie that the election had been stolen from Trump because they thought their defamatory marketing campaign would dupe Trump supporters into buying MyPillows."
@rparloff wrote a good piece about whether there's an insanity defense to defamation.

Clearly, Dominion has a stronger case if it can convince a jury that Mike Lindell is actually a savvy grifter who doesn't believe his own nonsense.

Breaking: DOJ will appeal the recent court ruling that blasted ex-AG Bill Barr's handling of the Mueller report and ordered the release of an underlying memo to @CREWcrew.

Congressional Democrats had urged AG Garland *not* to do this.
This filing from DOJ sheds light of AG Garland's thinking. In short, DOJ is appealing because this case would create a precedent, and because it's not happy with Judge Berman Jackson's view of a FOIA exemption known as the "deliberative process privilege."
One way of thinking about AG Garland's move tonight: He's not protecting Bill Barr so much as protecting the federal government's ability to reject FOIA requests in the future by invoking the "deliberative process privilege."
