Central problem with this thesis is that US health insurance isn't insurance as traditionally understood (paid transfer of risk). Instead it's a subsidized care regime. So incentive to reduce expenses isn't as sharp as, say, car insurance

Agreed. It's basically a wellness program under 42 USC §300gg–4(j)(1)(A), which basically allows up to a 30% premium reduction

Just wrapped a post-judgment pre-appeal strategy call with the appellate team, four our 1A test on the right to record police ☺️
Yeah I didn't notice the autocorrect until after several folks had liked it, so I left it 🤦‍♂️
2nd, 4th, 6th, 8th, and DC Circuits have not weighed in at all

10th Circuit sort of weighed in via Frasier v Evans, a very messy case here: law.justia.com/cases/federal/…

But ultimately 10th dodged the core issue in our case

Circuit split is definitely possible in the 4th
