Gaetzgate latest - what we know, and my take

What we know - indictment is coming in the next few weeks, either in August or just after

Also clear that the US Attorney’s Office is taking very strong positions with Gaetz and his counsel and is ready to indict Gaetz and others
My take on Gaetzgate based on what I’ve been able to find out

What’s really going on is that the feds are applying a lot of pressure on Gaetz to flip and cooperate — if the feds are taking a strong position, it’s to get cooperation

But what would Gaetz be able to cooperate on?
Gaetz could cooperate on the existing case they have open in federal court in Orlando — adding to the testimony from Gaetz’s buddy Joel Greenberg

But what else could Gaetz do? What other things could he cooperate on? That’s the more interesting question.
So to be clear, the issue with Gaetzgate is not *if* he will face charges. He will.

The questions are when and how. Does he cooperate now? Or does he plead not guilty for now? And what would cooperation look like?

If they’re having this discussion now, the indictment is ready.
As for the Politico story that the Gaetz case is stuck, that’s easy to take apart

Greenberg already went from 33 counts to 6. That is not something you do with a “bad” witness. He’s fine. That’s all BS

The part about a victim going into porn feels VERY much like a smear
The whole Politico story was probably sourced from Gaetz, his team, and/or his lawyers

The feds would never have said that their own victim was a potentially problematic witness. That came from the defense. Very common tactic - attack the victim, especially if female
Also - the issue with Gaetzgate is not a lack of evidence or lack of a case.

It’s that there’s soooo much evidence - and the case has gotten way bigger.

That’s why the initial June/July timeframe got pushed out — Greenberg’s cooperation opened the case up way more.

WTF is going to happen now in the DC case after the Supreme Court immunity ruling?

There is a silver lining here.

Judge Chutkan now takes back over - with a "fact-specific analysis" on whether Trump's actions were "official acts" or not.

This could be brutal for Trump. 🧵
The case now gets remanded back to the District Court, where Judge Chutkan is in charge. She's been ordered to engage in proceedings to determine whether Trump's actions were "official acts" of the office of the President, or "unofficial acts" of a candidate or citizen.
This not a trivial task.

For every single action Trump is accused of, we now need to know the 5 W's and H:

what he did, who he was with, where he was, when he did it, how he did it, and why he did it

We need testimony from the people he was with. We need to see evidence.

MASSIVE NEWS - DOJ says 60-day rule does NOT apply to Trump trials, because he’s already been indicted

So the Trump federal trials CAN happen even if they run into September/October

Drastically increases odds that Trump is tried — and convicted — before the election in November
This was stated by DOJ in the documents case, to Judge Cannon, regarding the trial calendar

It applies equally to the DC January 6 case before Judge Chutkan
For background: the “60-day rule” is an internal DOJ policy not to go forward with cases against elected officials or candidates within 60 days of an election

Up to now it was unclear how 60-day rule would be applied to the Trump trials

BREAKING: Judge Engoron decision on NY AG civil fraud case will likely NOT be released today.

Word I'm hearing is that the Court is aiming for early next week. Subject to change, could be later, or sooner.

Court had previously said they were aiming for decision by end of Jan.
So, while we're disappointed not to be getting the news today -- this is not a significant delay by any means. A few days, in all likelihood.

What will the decision contain? My bet: Trump to pay $200-370 million. Plus Court already ordered cancellation of corporate charters.
Next stop after this will almost certainly be the Appellate Division, First Department - this is the intermediate appellate court covering Manhattan. Akin to a circuit court of appeal at the federal level.

After that, the New York Court of Appeals, highest court in NY.

Here are all of the allegations against Alan Dershowitz in the Jeffrey Epstein documents:

1) Dershowitz came to Epstein's island "pretty often"

2) Epstein forced one underage victim to have sex with Dershowitz repeatedly, in FL, NY, NM, Virgin Islands, and on private jets
3) Dershowitz also witnessed Epstein and his co-conspirators sexual assaulting other victims

4) Dershowitz did all of this while also serving as Epstein's lawyer and negotiating a sweetheart deal that also gave immunity to "any potential co-conspirators of Epstein," e.g. himself
5) Epstein refused to testify on Dershowitz and instead pled the Fifth

6) 3 other unindicted co-conspirators refused to testify on Dershowitz's "massages" and instead pled the Fifth

7) Appears Dershowitz may have tried to smear Epstein victims by stalking their MySpace profiles
