Hello again from Judge Colleen Kollar-Kotelly's virtual courtroom, where sentencing is about to begin for Capitol rioter Boyd Camper, who pleaded guilty to the parading misdemeanor. Govt wants 2 mos incarceration, he wants probation.

"We’re going to take this damn place."
As Camper's sentencing gets underway, worth noting there was another sentencing this a.m. in a parading guilty plea case, for Sean Cordon — Judge Trevor McFadden ordered 2 mos probation + $4K fine, govt had asked for 3 yrs probation + home detention (no fine request)
AUSA Jacob Strain is up first, says by now the court is familiar with the "violence and mayhem" of the Capitol riot, what happened that day was "despicable and horrifying and un-American"
Strain says the govt concedes that when Camper entered through an Upper West Terrace door, there were no officers there "actively" preventing rioters from going in, but they do not concede he had permission to enter — "certainly not"
Govt notes Camper was recording with a Go-Pro but told the FBI he wouldn't turn it over without assurance the contents wouldn't be used against him — told the feds he "buried" it. His lawyer says govt ultimately was able to see some videos they provided
Strain said the fact that Camper brought his 10-year-old son to the Capitol (but not inside) indicated this was all a spontaneous series of events and not something planned
After govt criticizes defense sentencing memo for appearing to walk back Camper's admission that he knew he didn't have permission to go in the Capitol, judge asks Camper to explain, he says he clearly understood he didn't have permission
Camper's lawyer Nathan Silver is up, says his client, a former Marine, came to DC as a "patriot," was disappointed by the election results, "got caught up" in the emotion and excitement on the scene
Camper addresses the judge: He says he agrees with the prosecutor's description of the riot as "horrifying," says he didn't learn about the violence until a day or two after leaving DC. "I'm a very proud American, I would never take any action to undermine that."
Camper said that at the time he believed the voter fraud allegations, had no reason not to trust Trump, "that has since changed." He said he came to DC expecting Trump would present evidence, felt "duped"
Camper repeats an account from his sentencing memo that he took a pitchfork away from another person and threw it down, saying it was a nonviolent protest. He also noted getting chemical spray in his eyes. Govt had cited this as undermining his claim he wasn't aware of violence
Camper says he tried to fist bump an officer at the Capitol, the officer shook his head no to indicate he didn't want to be part of that
As for the CBS interview, Camper says he wasn't going to do it at first, then changed his mind, and complains that he actually did the interview alongside a Black woman and that they expressed frustration together, but CBS only showed a few seconds of him "out of context"
Camper said earlier that the only reason he went was that another person (he didn't name that person) had bought tix for him and his son as part of an arrangement to settle a third person's debt to Camper, and once that person was prosecuted, he contacted law enforcement
Camper says prosecution has changed his life — "canceled" by friends, fired by employers, bank accounts closed, ostracized by community, black-balled business-wise. Says the hardest thing has been people not wanting their kids to spend time with his son
Camper notes he has sole custody of his son, and asks if the judge is inclined to impose incarceration, that he be able to serve that in small chunks so he can make childcare arrangements
Camper concludes that he's not a "violent person," but sometimes he stands his ground when he should quietly back away, that he made "bad choices" and nothing he'd ever want to do again. Judge Kollar-Kotelly is taking a short break before announcing the sentence

After a lengthy recitation of Camper's personal history and reciting the facts he pleaded guilty to, Kollar-Kotelly starts sharing her thoughts on all this. She indicates she's concerned that Camper hasn't fully accepted responsibility for his role on Jan. 6
CKK says that although Camper didn't engage in violence, every person who joined the mob that day helped create the "momentum for violence" and made it safe for others to commit violence. She says it's reasonable to infer he destroyed evidence re: saying he buried the Go-Pro
Kollar-Kotelly: "Violence is an unacceptable way to resolve political differences."
Now: Judge Colleen Kollar-Kotelly sentences Capitol rioter Boyd Camper to 60 days incarceration, which is what the govt had asked for + 60 hrs community service. She says he hopes the sentence deters him and others from engaging in this type of "destructive" behavior again
Kollar-Kotelly says she hopes Camper recognizes that "you live in a country with incomparable freedoms which are protected by the rule of law. Eliminate the rule of law, and you jeopardize those freedoms."
The judge will delay his report date to the Bureau of Prisons to give him time to get settled after moving his family and make arrangements, and to avoid complications related to the US Marshals Service moving people around right now out of the DC jail
Camper's lawyer asks if he can serve his 60 days on weekends, given complications w/ care plans for his son. Judge says she considered that but no: "It's unfortunate, but when you get involved in criminal conduct your family suffers the consequences sometimes of your actions"

According to this filing, the Jan. 6 committee and the National Archives aren't taking a position on Trump's request for a temporary administrative injunction. The parties are jointly asking the circuit to set a more expedited briefing schedule on the main appeal
Clarification: The expedited schedule they've jointly proposed is for Trump to more formally argue for an injunction pending his appeal of the order denying a prelim. injunction by the district court judge — same core issue, different procedural posture

Trump also immediately appealed to the DC Circuit after Judge Tanya Chutkan handed down her decision last night. That docket is live, and a briefing schedule has been set. There's no request yet from Trump for action by that court before Friday

SB 8 — which deputizes private citizens to enforce the ban and provides $$ incentives to do it — has been in effect since Sept. 1, with the exception of a two-day period last month (see: buzzfeednews.com/article/zoetil…).
