BREAKING: Defense is making a motion for a mistrial with prejudice #KyleRittenhouse
Defense motion is based on prosecutor infringing on Rittenhouse right to remain silent and prosecutor attempting to admit evidence judge previously ruled would not be allowed at trial. #KyleRittenhouse
State is responding now.
Binger starts by saying he'd like more time to research.
He obviously wants to end this day and start again tomorrow.
Rittenhouse agrees you can't use deadly force to protect property.
Binger: Yet you have previously indicated you wished you had you had your AR-15 to protect someone else's property?
Judge sends jury out of courtroom.
Seems like Binger is hinting at a prior incident that judge ruled was inadmissible.
Defense accuses Binger of going for a mistrial and says he should be admonished & if it happens again defense will call for mistrial with prejudice.
Judge starts yelling.
Judge is furious.
"I don't know what you're up to."
Marshall testimony finished.
Defense recalls Anmol Khindri, son of the owner of Car Source. #KyleRittenhouse
Khindri testified on Nov. 5 that he did not know how much the total loss to their property was.
Defense is challenging that
Khindri says he now knows it's about $400K & that he learned that in the last week.
Defense disputes that, shows video interview with Khindri, shot the day after the riots. Shows all the cars on lot destroyed.
In video Khindri says, "if there's no gov funding for this, there's nothing we can do."
This is drone video the state go ahold of Friday. It shows #KyleRittenhouse shoot Joseph Rosenbaum. It's the clearest, steadiest video of that shooting.
Jury watched multiple versions including one that was cropped, zoomed in & slowed down by the crime lab
After the jury saw this, the medical examiner testified about Rosenbaum's injuries.
ME says fatal shot was to the back, when Rosenbaum was horizontal to ground.
Defense says Rosenbaum is lunging at Rittenhouse.
State says Rosenbaum is falling forward because he's been shot.
ME testified both theories are plausible.
I think this drone video will be key in helping the jury decide which they believe.
